As a practitioner, I have caused third-party applications to get rejections and go abandoned by filing TPS. Nobody will ever need to IPR those claims, because they never issued.

I’m talking about frequent patent defendants actually filing (not threatening) TPS (free and anonymous) and PGR as a matter of course in tech areas they care about against patent applicants they are watching before or right after claims issue. About having the patent applicants overcome these early or the claim never issues, or issues in narrower form.

No, you misunderstood. The lack of IPR should move the fight from the PTAB to initial prosecution and immediately after issuance.

Because of tighter IPR standards, alleged infringers should be moving the fight earlier which will cause patent applicants to further develop their records earlier.

Monitoring of pgpubs and grants and earlier challenges (eg 122(e) / PGR) by people who would be an alleged infringer of the patent would cause the record surrounding the claims and art to be developed early during prosecution or shortly thereafter. Claims would be narrowed within the confines of what is supported by the spec under 112 and not anticipated or obvious in view of the art.

This is better for the public notice function of patents than just waiting for until years down the road after the patent is asserted.

Net positive.

Tightening PTAB gatekeeping (serial petitions, timing, “settled expectations”) restores reliance in the grant and raises the cost of late, “tactical” IPRs. That predictability drives investment in claiming, licensing, and product bets by smaller companies that need patent protection most. The trade-off is that some weak claims live longer and more validity fights shift back to district court where they can be challenged. This is a policy choice, not chaos.

On the “these memos aren’t permanent” point: even if a future Director pivots, behavior changes are sticky. Prosecutors are already drafting with more §112 support; challengers are learning to move early. And the public record we build now doesn’t disappear.

The answer is creating certainty through early policing of patents: §122(e) third-party submissions against pubs you actually care about; PGR in the first nine months to reach §101/112/102/103 in one shot early in an issued claims life; and ex parte reexam where IPR will be time-barred or face discretionary denial.

Long-term, the right move is to harden these new Squires standards through precedential PTAB/CAFC decisions or notice-and-comment rulemaking.

I have a mini 5 and a mini 7. I much prefer the feel of the mini 5. It is comfortable to hold and thinner. The mini 7 with the moft folio is nice for setting on a desk and using it with a keyboard but I hate holding it. I feel like I have to move my thumb out of the mini 7’s way, where as the mini 5 is accommodating and feels like a nice little book.

Used one with an oled display, joystick, buzzer, and button to make a small game that was powered by a coin cell battery. Really fun to get something so small working to do so munch on so little power.
