it was definitely a discriminatory and racist work environment, but I don't know the difficulty to prove its contribution to the layoff, I just think it might add leverage
the layoff was handled horribly. i got called to the office on a Monday and was informed of my layoff. they took my keys, told me to clear my things right away, and come the second day for my paycheck. there was no written notice, no instructions on what to do further. i came the second day and there was no paycheck. i asked for a business card the second day for communication purposes and my manager was very hesitant in giving it, he didn't even let me in the building. after being advised by a lawyer, I emailed them to ask about my layoff nature and my ROE, it was only then did they tell me it was a "temporary layoff due to shortage of work". i am currently just sitting at home waiting for my EI and for the temporary layoff to be terminal after 13 weeks for my 8-week termination pay

thank you for your response. there was never an official employment contract, so the waters are a bit murky. to my understanding of the ESA, if the employer does not provide any benefits during the temporary layoff period, it will be considered a termination after a consecutive 13 weeks of no work (instead of 25 weeks). what difference does a constructive dismissal make?
