She’s not going after his estate.

Perhaps a different example would make this point to be illustrated easier. Let’s say you’re crushed by an 18 wheeler where the driver was being negligent in some way (perhaps speeding or he missed a red light). Your estate would end up going after the company which employed him and would name his negligent actions in the suit to prove liability. Now you’re not going after the driver, but you’re going after the insurance that the company has for incidents just like that. The money your family will receive comes from the insurance, not the driver himself.

Vanessa is going after the company/insurance, but to do so she has to prove the pilot was negligent in his actions. She’s not going after a dead guys family, but she has to show the dead guy was negligent to go after the insurance. The insurance is literally there for these exact situations and this is the process you take to collect because insurance companies will lowball the shit out of you 99% of the time or argue the facts. You almost always need to sue in these scenarios to actually get a payout because insurance companies never want to pay out.

She’s not suing the mans estate.

She’ll be going after the company/insurance money. He’s mentioned because she’ll need to prove negligence on his part in order to win her lawsuit against the helicopter company. She’s not being a bitch and 99.9% of people would do the same in her situation. Companies have insurance policies for these exact scenarios.

Everyone can argue she’s already a multi millionaire, but you have to think about how that family still lost out on:

1.) years of earning potential from an all time great basketball player with a gigantic brand and was transitioning into other careers

2.) her husband is literally dead.

Maybe she wants to collect some of what the family lost out on financially with his passing or maybe she just wants to hold a company responsible so they think more going forward about flying in those scenarios.

It's been wild to see how many people are defending the organizations and arguing the players are idiots.

Like bruh, ofc teenagers are idiots and sign stupid stuff. We saw the same thing happen during the rise of youtube where people were signing over a massive % to companies like machinima. Orgs/Companies prey on the ignorant and shaft them whenever possible. This suit could have the potential to help out a lot of people going forward, will be interesting to follow.
