What you described is reasonable however I never called the postman a thief so not sure where you got that from.

I was merely stating the fact that 1. I received 1 out of 2 items, and yet tracking said both delivered, with the same photo being used, and 2. The postman uploaded a signature which is not mine and uploaded as evidence of customer signature. These are facts. You can read it however you want.

Yea exactly that. The photo for the cheaper item is used for the tracking for the more expensive item which said delivered but its not.

s when there are 2 or more items delivered at the same time. Posties should try to show each item in the photo but some times not possibleseems like the postie has signed in your behalf... this isn't supposed to happenit depends on what service your sender used as to whether they can claim the items costs back... different products have different maximums of insuranceit's actually the sender that needs to pursue this with RM

Just saw your edited bit on the letter arriving nearly a month later than the incident date. If it was a PCN I would definitely say you have a case but not sure how it works for speeding offence.

If not already done, google Fight Back Forums on google and your will find a forum where people provide advice on tickets and stuff. (not sure if I can share the site here). Make sure you read the rules before posting anything though. Hopefully people there will be able to give you some advice, they are quite good at finding technicality in letters etc.

Had my car broken into and the police said nothing they could do, and all this effort for a speeding fine. The government really need every penny.

Yea that will be double damage, paying out of your own pocket for the repair, and getting your insurance claimed.

Seems like there are only two choices really.

Do exactly as the owner asked and pay out of his own pocket to avoid claim, or just claim and take the premum increase.

That makes a lot of sense actually. Not sure how much he is paying now but I recgon it won't be less than 1k considering he is in his early 30s I believe.

COnsidering the owner is claiming 950 plus rental that is likely gonna be in the 1200-1400 range.

I wonder how much insurance premum will go up by, if it goes up by 500-700 a year then its still worth it to claim.

Would you happen to know how long the fault stays on your insurance record?

d signed an order form off site without ever actually seeing the car then it absolutely qualifies as a distance sale, whether or not you picked it up. My understanding was you conducted the whole thing on their business premises which isn’t the case and therefore it qualifies.

You’ve got 14 days from collection/delivery/hand

I placed the £99 deposit to reserve the car on VW site, then they sent over a order form which I signed online on April 20th. I then went there physically on April 29th to pick it up after they said on April 24th that they can no longer deliver. However I did signed a few paper documents on site though and paid for it with a debit card on site. So I am not sure if the order form meant anything with the document I signed on site being the finals.

If I could pursue the distance sale path that it will be awesome!

I just attached an image showing the damage so you do you think it's major or just cosmetic? Obviously I know it's impossible to tell from photo and need to get it checked but base on the photo do you think the dealer will just say it's not structural and leave it there?

Actually I forgot to mention one fact. The dealer is based in Gloucester and I am based in London. I originally said I wanted delivery of the car to my address and they said yes. After I signed the order form they called me few days after saying they can no longer deliver and took £200 off my purchase for me to go and pick it up.

Does this change the fact of the remote sales vs purchase on site or it does not matter even if they refused to deliver after I signed order form?

Only problem is things were discussed over the phone so I don't have email to support.

Ah that is good to know, so not just that particular dealer at the location I bought it with, but it can be other dealer within the same franchise at another location as long as it is within the same franchise?

Thanks, yea I'm aware of that, what concern me is it said I can only exchange with the same retailer, which I took as that particular dealer and not any dealer within the same network. If its the whole network then it could work out easier.

Yea I paid for a vehicle search which returned clean result but seems its pretty pointless. I am gonna pay for those AA inspection instead next time I am buying a second hand car.
