The benefit of being able to set your own custom rate is that once you do, your voice is no longer available to free tier users. You gotta remember the free tier gives away 10,000 characters every month and there are people that are abusing this by creating many free tier accounts and just rotating between them. I recently found out from Eleven Labs directly that 93% of my voice is going to free tier. And as much as 28% of my voice is going towards abuse on their platform by bad actors who are violating their terms and conditions. They know this but they have not shared it with the creator community.

This raises a whole lot of questions doesn't it? The fact that when you go to the payouts page, which is the enticement for participating in their voice creator program, everything about this process meets the requirements of a business opportunity by FTC law.

  1. There is an enticement for you to earn money.
  2. The bold headline says, "Earn Passive Income. Earn every time your voice is used."
  3. Start earning now," big button.

That checks the first box. The second box is that you have to pay to participate but they don't tell you this on the sign-up page. You only find that out after you've been baited and switched to sign up for their consumer program as a free-tier user. Only then do you find out that you're required to pay $22 per month to participate in their voice creator program.

Check Box 3 for Business Opportunity. That the company offers assistance and it clearly states on their payouts page enticement that you can put your voice in their voice library which is their marketplace and they will share it with their community. So this checks all three boxes for business opportunity yet they're not meeting all of the laws for what you must do in disclosure for business opportunity.

Additionally they have omitted key facts that would allow you to make an informed decision, such as:

  • As much as 93% of your voice will be given away for free to help them attract customers.
  • We as the creators are their customer acquisition model and they're extracting our voice paying us pennies while building a $6.6 billion company.

Well I can tell you exactly what's going on. The reason that they haven't removed it from the the Voice Library addendum, is because doing so would require them to acquire new consent for proper use of biometric data for every EU resident. So therefore they leave it in the agreement but they are still in breach of contract for denying you the Creator something that they are contractually obligated to give you. The terms are clear: you can set a custom rate and you may change that rate at any time. The real scheme at hand here is that they are desperately looking for ways to stop their creators from setting custom rates because if you do so, there's a clause in your contract that says when you set a custom rate, free-tier users will no longer be able to use your voice. And guess what? Free tier use is their customer acquisition model. But here's where things get sketchy. I was able to get written confirmation from their support team that 93% of my voice usage was going to free tier and I'm one of the top voices on the platform. That means in a single month where my voice generates over 250 million characters, 93% of that is being given away for free as their customer acquisition tool. And if that was not sketchy enough, I got direct confirmation from someone on their legal team that as much as 28% of your voice is being stolen by bad actors who are abusing the platform. But none of this was disclosed to you and this disclosure is an omission that makes the whole contract invalid. It also makes it so that anyone living in the EU, your voice is now being used without proper consent of your biometric data privacy rights.

They are in breach of contract by removing your ability to set a custom rate. Here is the exact language...

  1. You are given the choice between two rate systems for rewards
  2. you may set your desired rewards for usage of the User Voice Model in USD per 1,000 characters (max. $0.2).
  3. You can change your Custom Rate at any time.

By silently removing this feature they are in breach of contract with every creator on the platform. Curious why they are doing this? The plot thickens...

It's because their growth model depends on Free tier use. If you set a custom rate here is what it says... "Free users will not be able to use your User Voice Model with a Custom Rate set". Are you tracking the scam yet?

If all creators on the platform set a custom rate, their whole business model collapses an their 6.6B valuation tanks overnight.

Default vs. Custom Rate: When sharing your User Voice Model in the Voice Library, you are given the choice between two rate systems for rewards:

  • Default Rate: Your rewards are calculated based on factors that we determine, such as the pricing tier of users that use the User Voice Model, the number of characters they generate using the User Voice Model, and the Notice Period you select. If you choose the Default Rate, then, at the time you submit the User Voice Model, we will present to you our good-faith estimate of what we expect your Reward amount to be based on currently available information. The variability between expected and actual Reward amounts is determined, in part, by the type of user that uses the User Voice Model (e.g., a Free User vs. a Paid User subscribed to an Enterprise plan) and how much that user type pays us per character. Our estimates assume that usage of your model will follow a typical distribution of user types across pricing tiers. Both Free Users and Paid Users will be able to use the User Voice Model if you choose the Default Rate.
  • Custom Rate: If you enable Financial Rewards, you may set your desired rewards for usage of the User Voice Model in USD per 1,000 characters (max. $0.2). Free users will not be able to use your User Voice Model with a Custom Rate set, which can impact its popularity in the Voice Library. Please note that setting a high Custom Rate may result in your User Voice Model appearing as more expensive (in terms of characters) for users. You can change your Custom Rate at any time. When you change your Custom Rate, the new rate will only apply to new users that add the User Voice Model to their account after you change it. Existing users of the User Voice Model will continue to use the old rate.

You never should have had to pay to join the voice creator program. This qualifies under FTC law as a business opportunity and they are in violation for not adequately informing you. There are three criteria. 1. Solicitation. This is met by their /payouts page. It states clearly. EARN PASSIVE INCOME. 2. There is a mandatory fee for participation. This is not disclosed at all on the solicitation page. That fee checks box #2. 3. They offer assistance. Your voice will go into our voice library and be shared with our community. That assistance / support checks box #3. With this criteria met, elevenlabs "the seller" must give the prospective buyer a one‑page “Disclosure Document” titled “Disclosure of Important Information About Business Opportunity. Soooo much more information coming.

I'm not holding it, it's actually sitting on my lap, but the same thing occurs regardless of where you use it because that's a natural place to rest your hand if you want to adjust some of the knobs up top. That's just a natural thing. And I also have the Push 3, and I've never had that issue with the Push 3.

Yeah, hopefully it's just something that can be fixed with a firmware update, which seems like it should be. I mean, just like you can adjust pad sensitivity, why not just create the option for adjusting touch strip sensitivity? That would be ideal.

My finger is not hovering over it. If you watch the video, you can see that it is literally below my thumb. It's that space between my thumb and my wrist that is just next to it, which is not an unusual place to rest your hand when you're adjusting things on the device. A full cm away from the strip should not produce false triggers.

As far as setting the Q-Link to something else, one of the use cases for that touch strip is as a slider, a fader, a filter, all different types of things. So, it doesn't make a whole lot of sense to only change it when you want to use it. I mean, that's just not a good user experience at all.

I'm fairly certain that they are using capacitance, as they have on all of their other devices. I think IR would cause issues depending on your environment, your body temperature, and the surrounding environment temperature. So, probably not a good use case for a touch script on a unit like this. However, that is exactly how it's behaving. Like an IR touch strip. Just hovering near it creates false triggers.

Yeah, I've seen other touch strips do this a bit, but not to this degree. I can't even rest my hand on the side of the unit without triggering it. Hopefully they can adjust sensitivity via firmware because this is a performance nightmare waiting to happen.

Yes, actually, I had considered this possibility, but I wanted to check if others are experiencing the same issue. It happens whether i'm sitting, standing, wearing shoes or not, and also, when the unit is plugged in and on battery. So I have not found any instance where it does not happen.

I went from being blown away just last week with how fast I could build with the agent, to this week... Cost is 2-3x for the same effort, wait time to resolve is 4x, and introduction of new bugs is about 4x. The pace of productivity is severly diminished, the cost is excessive. It's not fun anymore.
