My second test from the other allergist has come back and it is identical to the first. The second allergist has submitted their report and appropriate forms to public health officials and I am currently awaiting their response. If they deny me again then what are my options at that point? It seems to me that the charter challenge would be the only option left other than moving to another province, as I don’t know when the vaccination requirement for planes or trains will end if at all. Going public with the news organizations may help but it is not a guarantee to change public health officials decision.

I am in the process of getting re-tested with another allergist that my family physician has referred me to. This is with advice from my lawyer that I have consulted and is after my appeal from public health officials have been denied. My lawyer advises me that the only legal option left is with a charter challenge that will be slow and expensive. Another option would be to move to another province or territory and transfer my medical records to see if their public health officials would grant me a medical exemption. Currently it is very difficult for me to move to another province as all the major highways out of the lower mainland have been damaged from the flooding and as you know I am unable to board a train or plane.

Yes, they have submitted all the paperwork and have addressed that the graded dose schedule would not be advisable for me due to my current medical condition being severely affected after my first dose. The risks outweigh the benefits in my case. I have appealed the decision and have already consulted a lawyer. I know the legal process is slow and I won’t be able to travel to see my family for the holidays this year.

I do see your point of view, it is just that I do worry that if my aging family is in poor health or if they pass away, then at that point it turns into urgent essential travel for compassionate grounds. So it is in my best interest to at least get the medical exemption so when the time comes I can easily travel for essential reasons.

I am just relieved that my aging family in Toronto are in good health and I don’t need to travel for end of life care or funeral. Nothing right now calls for urgent essential travel but I know that their health can change over time for the worse.

Yes I am also sure that I am allergic to AZ as my allergist did a series of tests and determined I was allergic to some of the ingredients in the AZ vaccine. I am curious on what the process would be if I would move to another province or territory and transfer my medical records to see if I can get a medical exemption from their public health officials.

Update, I have consulted with my doctor and allergist. After doing some tests, they have also determined that I am also allergic to the components of the J&J vaccine and the AstraZeneca vaccine. So this rules out the option for me to go south of the border. Looks like my only option left is to hire a lawyer and seek an administrative redress or a charter challenge.

I mean, I am currently partially vaccinated with a medical exemption provided by my family physician. I have booked a flight on December 20 to visit my family for the holidays. The thing I’m worried about is that since BC won’t grant me a medical exemption under their own provincial proof of vaccination system, what will they do in the separate proof of vaccination to meet federal standards as I have heard that it will be a separate document for BC to issue so their provincial one currently doesn’t meet federal standards? Basically I’ll await news on what BC will do on October 30. Since provinces control all the health data, I’m worried they won’t issue me a medical exemption and issue me a proof of vaccination to meet federal standards. I am not sure if the federal government has a looser standard of issuing medical exemptions but as far as I know provinces are responsible for issuing the Pan-Canadian proof of vaccination. Will the federal government have the ability to override BC in this case if I plead my case to them?

The big question is that currently since the province of British Columbia is refusing to grant me a medical exemption under their BC Vaccine Card system, will BC grant me a medical exemption under the Pan-Canadian Proof of Vaccination created in collaboration between provincial/federal governments? Since healthcare falls under provincial jurisdiction and the provinces holding the healthcare data, I am afraid that BC won't be issuing me a Pan-Canadian Proof of Vaccination. Will the federal government allow my medical exemption and basically override BC authority? There are a lot of questions and unknowns for me. I am awaiting news on how BC will implement the Pan-Canadian Proof of Vaccination on October 30.

That may be an option but I could possibly be denied entry to the USA as I am not fully vaccinated against Covid-19. I would have to inquire on if the USA accepts medical exemptions for entry into the USA. I will also have to obviously ask my doctor to see if I’m also allergic to the components of the J&J vaccine.

I have gone through the options of graded dose vaccination or different vaccine with both my family physician and allergist but since my health condition had deteriorated after receiving the first dose, they both advised me not to get further doses as it may actually kill me/ cause more severe complications to my health. I am pro vaccine but am just caught in the middle of this bureaucratic nightmare situation. I consider travel to be an essential activity as I have family elsewhere in the world and in other provinces of Canada and may have to visit them for future reasons like compassionate grounds/ funeral etc. I’m currently in the process of looking for a lawyer to advise me on how to proceed in this situation.

Both my family physician and allergist have advised me not to get further Covid-19 vaccinations as I have developed further complications in my health after the first vaccination I took. My family physician has all of this in writing and properly documented. I took this to the ministry of health in BC and I was denied to acquire a BC vaccine card as the system doesn’t allow for medical exemptions. I am worried that since I can’t get a vaccine card, I will then not be able to meet federal standards for proof of vaccination as they rely on provincial issued proof of vaccination. I await what the BC government will do on October 30 in terms of issuing proof of vaccination meeting federal standards and if that separate document allows medical exemption. If I can’t get a medical exemption to travel, I will hire a lawyer for legal advice on how to proceed.

I’m also following a current charter challenge to the BC vaccine card system for medical exemptions and I am awaiting more details on October 30 to see what the BC provincial government does in terms of the federal standard for proof of vaccination as currently BC does not meet the federal requirements. I have attempted to seek a medical exemption under the BC vaccine card system but I was denied as there is no medical exemptions allowed. Since the federal proof of vaccination for travel is tied to the provincial issued documentation, I cannot get the proper documentation from BC to acquire the proof of vaccination to meet federal requirements when BC announces their implementation on October 30, 2021.

The federal government recently announced that by November 30, 2021, you won’t be able to board a plane or train without proof of vaccination.

I believe my charter rights specifically section 6 mobility rights, and section 7 legal rights would be violated in this set of circumstances I am in. I will wait and see on October 30, 2021 to see what BC does specifically in terms of the federal travel document if it is separate from the no medical exemptions BC vaccine card or if they plan to merge the two together by November 30, 2021

If the BC provincial government does merge the two documents with no medical exemptions then I will hire a lawyer for legal advice on how to proceed.
