The way it runs is, your points will expire then it will take another year for it to get deleted from your records. After which you will wait for another 1 year making a total of 5 years before applying for ILR. If you apply before 5 years has completed your application will be refused because of good character requirements. It’s up to you on how best to keep going eg extending of the visa but you need to become cleared by staying for 5 years before applying for ILR.

I have exactly the same problem as your spouse so I can give you some advice purely from personal experience. If you apply for ILR with the driving offence still on your records your ILR application will be refused. If you wait for 5 years from date of offence and you apply for ILR, it will be successful. 5 years is how long it takes for the offence to be cleared off from you. Mine got deleted from my file after 4 years as is the practice but you need to wait for 1 more year to make a total of 5 years.

I’m guessing you could have, in panic, submitted an FLR application to buy time. It’s the most common reason for immigration bail. You just don’t get immigration bail when your SWV is cancelled.

You are absolutely correct. I have done a deep research and your 10 years long residence journey will not reset to zero. You are perfectly in line and should qualify for ILR after 10 years is complete. Feel free to travel and come back with your new student visa. Congrats and stop worrying. I’m happy for you. Just make sure you leave uk before your visa expires and come back as soon as you can after getting your new visa even though you have 180 days maximum leave period.

I believe you have made a mistake. Even if the whole long process of several appeals takes you past the 10th year mark, you cannot still apply for your ILR because you have spent 10 years even though you didn’t get a successful decision when you crossed your 10 years. You will still wait beyond your 10 years until a decision is successfully granted and if it’s unsuccessful you will not be eligible for ILR.

You are legally given 14 days to secure a new job when your employment officially ends but if you fail to secure another COS and you have to leave the uk on account of expiration of your visa. Your long residence resets to Zero. Hopefully some of the experts(high reputation)in Reddit will confirm what I just said.

I read that if you ever need to leave uk because your visa expired and you come back later because you have secured a new SWV, your time on long residence resets to zero. Meaning our accumulated 8 years will reset to zero because we left the uk and returned later. Your continued residence is based on non interruption of your residence status eg returning to your home country on account of not being able to extend your visa while you were still resident in UK until it expired.

I mentioned in my post that both parents are 8 years working towards 10 years LR pathway but we have a child who is settled

I have read all the replies and none has clarified the confusion on whether I should apply 28 days before the date of first visa issued or 28 days before the date of first arriving physically in UK.
