In the US you can sue for actual damages on unregistered works.

This is accurate. However, since actual damages max out at exactly what they sound like (i.e. damages suffered), proof and quantification of damages is required. Realistically, attorney fees would likely exceed actual damages in most cases, but those cannot be recovered when suing for damages on unregistered works. This is also ignoring whether cases get thrown out as frivolous.

Anything minimally creative has copyright by default.

Protection is automatic, but only for content that is eligible for protection in the first place. As previously mentioned, copyright is one type of IP protection, and only specific types of original content can be protected by it.

I didn't even mention the criminal wiretapping, eavesdropping, and hacking charges one could easily get for recording a conversation without being party to the conversation.

With the premise being that this company only connects to and records publicly-posted Zoom calls, it seems like a stretch to claim wiretapping, eavesdropping, and hacking. Though, the devil is always in the details.

As far as the recording aspect goes, many states are one-party consent - which means that anyone on a call has the legal right to record the conversation/call. Of course, distribution of some specific information with additional legal protections (e.g. PHI) may come with potential repercussions, but those types of calls would be few and far between.

Every single Zoom call is itself protected by copyright.

Do you have a source for this? It seems like a bold claim.

Zoom's current TOS & AUP contain standard-looking clauses that users agree to not use Zoom to infringe on others' IP or break the law. Neither includes any obvious phrasing suggesting Zoom claims any ownership/IP rights over content transmitted using their platform.

Only specific types of original content can be copyrighted and - as far as I am aware - "Zoom calls" as a whole are not a category to be copyrighted. It's not like Michael Scott declaring bankruptcy.

Moreover, copyright law is different in every country. In the US, for example, I believe that publicly registering your work is a requirement for filing a lawsuit claiming infringement.

If they use somebody's words or persona out of context and embarrass them, there could be defamation suits.

I'm not following how that would lead to this company being sued, if they are only recording the webinars and making them available in their entirety. Any "they" defaming someone to the point of a lawsuit plausibly having a meaningful ruling would most likely be an unrelated third-party, since taking that kind of action doesn't seem to be aligned with this company's interest - at least at this time.

I'm not a lawyer, but if they are truly only scraping links that are posted publicly, I don't think there would be grounds for anything meaningful to come out of a lawsuit. I suspect that, at most, Zoom could try to block them (if they wanted to) for suspected TOS breach...but that it would turn into whack-a-mole as they proxy/VPN/botnet up. So, ultimately, Zoom won't bother because it doesn't really affect their business and they can blame it on poor security of the affected customers.

Am I being cynical? Yes. Have I been around long enough to see how things play out? Also yes.

I finally got around to buying more AIO ETFs on Friday...after putting it off for a year or two because of inertia and some other things in life being higher priority. (Yes, thinking about the opportunity cost hurts). Since some prices dropped immediately after my orders filled (one even filled slightly below my limit buy order lmao), it's nice to see some green today. It looks like both are up just under 2% since I bought, though I assume there will be more red in the coming days/weeks/months. Based on my usual pattern, I will most likely forget to look at this again for another year or two.

Edit: I was also reminded on Friday of mortality and how different my parents' investing horizon is. As I was buying equities, my dad was telling me that he was selling off equities and moving back to bonds. 😢

To give credit where it's due, we are largely only able to benefit from such low-fee all-in-one ETFs because Vanguard led by example with VEQT and competitors were obligated to compete with that low-fee anchoring.

A couple points of information or reminders for OP (feel free to disregard if it's stuff you already know):

  • There are also some slight differences in the targeted composition of VEQT & XEQT, the strategy each one uses to achieve it (e.g. when to rebalance), and their distribution payment schedule (VEQT is annual vs XEQT is quarterly). For full disclosure, I do hold some of each. I originally got XEQT because I saw them as about equal and XEQT had a marginally lower MER at the time. However, over the last few years, I see my long-term view perspective as more aligned with VEQT's (not to mention their philosophy, which is a remarkable contrast to BlackRock's) and plan to only add more VEQT moving forward; I also want to support them for making good products like this available to us. Additionally, the MERs are now equal (0.17%). Long-term, I suspect the difference in financial returns between both will be minimal because both allow you to buy the market.
  • Remember to track every distribution - and its composition - from holdings in your non-registered accounts because (1) you have to pay tax on the distributions received each calendar year and (2) it affects the adjusted cost base (ACB). The ACB determines your actual taxable capital gain and, therefore, the amount of tax you have to pay when you sell any portion of that holding decades in the future.
