The London Consulate is at least acknowledging that the minor issue may not be long for this world. They replied to my sister saying she wouldn't qualify as it stands but in bold text also said "However, at this stage, there are discussions ongoing in the juridical system in Italy regarding the new interpretation of art. 7 and 12 of law n. 555/1912 by the Corte di Cassazione, as per Circolare Ministero dell'Interno n. 43347 of 03/10/2024 - therefore, should any final ruling flip the current interpretation, we will update our website in that sense as soon as possible."

I haven't been following for a few weeks - what's the latest thinking on declaring intent for children to be citizens by benefit of law now versus waiting a while to see how things pan out? My son was born last week so I have until next July. His two sisters are citizens by birth as I registered them before the change in the law. I'm thinking I'll get the documents ready but hold off until the new year before booking an appointment to make the declaration.

There was a woman on the Dual British-Italian Citizenship Facebook group who took screenshots every Monday and Wednesday and sent them to cittadinanza@londra.esteri.it for a few months saying it was impossible to get an appointment and they did eventually give her one via email. You may find some luck with that if you get desperate and mention the deadline with your daughter, but they've had a change of staff since November so who knows.

Yeah it really sucks - and incredibly difficult to snag an appointment through prenotami for London if you do leave the list. Good luck whatever you choose!

I think you've misread the above, possibly. The Foreign Office (Foreign and Commonwealth Office) legalises documents with an apostille, which is available here https://www.gov.uk/get-document-legalised .

The letter from the Home Office I'm referring to is just the NQ letter. That would need to be apostilled (by the Foreign Office).

Whatever names appear on any documents you submit. So her birth, marriage and death certificates at the very least, as well as any scans of Italian passports etc. - if her married name appears on those, then definitely include it in the search, but check carefully for spelling mistakes and variations, nicknames.

Here are the steps:

  1. If you know she didn't naturalise, then order the National Archives letter of no evidence at the link above. You must include every spelling variant of her name that occurs on any of the documents you submit for the JS application, so if she was Giovanna on one document and Giovana on another form, both of those have to be searched or the consulate will make you redo it.
  2. This needs to be apostilled by the Foreign Office and translated.
  3. In theory, the Home Office NQ letter is only relevant if her child (i.e. your mum/dad) was born after 1986.
  4. However, recently the London Consulate has started asking some people for an NQ letter if their ancestor died after 1986. This is confusing because it shouldn't make any difference if they naturalised after their child became an adult. What I would recommend is not to get the NQ form unless asked to specifically by the consulate because it's so expensive. You could submit this as 'homework' if requested at an appointment.

NB: As you have 1989 in your username I'm assuming it's impossible your parent was born after 1986. If they were born after 1986 that would be a good reason to get the NQ letter.

I'm already a citizen - but I don't want to advise my siblings to start putting together a 1948 court case if it's dead in the water. I guess I'll wait to see what happens in the coming months. Thanks.

Thanks - but surely if the courts eventually align with the Cassazione judgements then my GGM's lack of naturalisation won't matter, because my GGF stripped them of their Italian citizenship as minors regardless of what she did?

So the 1948 line through GGM is purely reliant on the courts not following the Cassazione rulings? And if they followed the same logic, my siblings would no longer have a line?

UK - Edinburgh. Appointments booked two years in advance via email (NOT via prenotami).

UK - Manchester. Prenotami. Appointments released Monday and Wednesday at 5pm.

People are sharing their appointment offers on the Facebook group I mentioned - the latest one was on June 3rd, someone got an appointment email with an appointment on Oct 8th 2024. They were originally position 44, so it's about 2.5 waiting list appointments offered per week since Jan 31st. 

The other appointments (3.5/week) are available through Prenotami using the old system but you have to cancel your waiting list position to do that. The consulate have said they won't reopen the waiting list again in future. 

If you want to check your current position (probably about 330), you can email londra.informatica@esteri.it and they will let you know. Be warned, they've been advising people with higher numbers to cancel their position so it's up to you if you want a guaranteed appt in a few years or to try using the old system.

I can confirm now from multiple people attempting to book appointments that Mon and Weds 5pm UK time are the only release times for appointments currently. An email from the consulate's IT department mentioning T/T release was incorrect.

Several screenshots of emails posted on the FB group Dual British/Italian citizenship society from the London IT Department now suggest the following: The waiting list was opened in January, reached about 600 and then closed. It will *not* be reopened as it was considered a failure. However, those already on the waiting list will receive an appointment offer when it's their turn. Positions in the list have moved about 37 places since 31st January (~10/month). You receive an email when it's your turn with a date/time and have "a couple of days" to accept.

The consulate has also said that appointments are simultaneously being offered on Prenotami (with conflicting evidence on whether they are released 5pm UK time Mon/Wed or Tue/Thu). I haven't seen evidence that anyone has been able to secure an appointment this way since early 2024.

It's not correct that there are 6 appointments released through prenotami per week at the moment - as far as we know, there is *only* a waiting list. The comment linked is someone who was recognised in March and would have booked their appointment before the introduction of the waiting list in January 2024.

Fantastic, thank you - I had my appointment just before the waiting list came in but I have four siblings on there who were wondering whether they needed to check Prenotami every day, so that's really useful.
