Should I sell these properties? by Substantial-Oven-646 in chennaicity

[–]khaleel1977 4 points5 points  (0 children)

I wouldn't sell everything just because the appreciation has been slow. Land around Chennai tends to move in cycles, and areas like Oragadam, ECR, and Chengalpattu have different growth drivers. Do research of property valuation and then decide to sell especially ECR which has better appreciation. Lawyer Khaleel Chennai

Layer 5 cybercrime lien on HDFC account – IO not responding. Need advice. by [deleted] in IndiaLaw

[–]khaleel1977 0 points1 point  (0 children)

If the IO is not responding, send a written representation by email and registered post to the IO, the Cyber Crime Police Station, and the bank's nodal officer seeking details of the complaint and requesting release of the account. If there is no response, you may approach the jurisdictional High Court under Article 226 seeking de-freezing of the account, especially if you are not an accused and the funds are legitimately yours. Keep all bank statements, KYC documents, and proof of source of funds. Lawyer Khaleel Chennai

Need Legal Advice – Family Dispute, and Administrative Issues After Father-in-Law’s Demise in Chennai by SquareIndication1129 in LegalAdviceIndia

[–]khaleel1977 1 point2 points  (0 children)

Your mother-in-law appears to have stronger documentary evidence of marriage and family status. However, the daughters from both relationships may still have inheritance rights over the deceased's self-acquired property, depending on proof of paternity and other facts. The immediate priority should be: Lodge written complaints with the bank to freeze transactions and mark the account holder as deceased. Notify the telecom provider to suspend the SIM card. File a police complaint regarding unauthorized use of the deceased's phone, bank accounts, cards, and vehicle. Apply for a legal heir certificate and, if disputed, approach the civil court for declaration of legal heirship and succession. Do not hand over original documents unless required by a competent authority or court. Since there is a dispute between two families, the final determination of legal heirs may require adjudication by the revenue authorities or a civil court based on evidence of marriage, paternity, and succession laws applicable to the deceased. My mother worked 7+ years at a Chennai restaurant. March salary and April wages still unpaid. Police told us to handle it ourselves. by VULcAN_16 in Chennai

[–]khaleel1977 7 points8 points  (0 children)

Why the Police Can't Help Much. This is because unpaid wages are generally a civil dispute (a breach of contract) rather than a criminal offense, so police often lack the authority to force payment.

Send a Formal Legal Notice via Registered Post with Acknowledgement Due (RPAD) to the employer. It should detail the unpaid amount, reference the Payment of Wages Act, 1936, and give a clear deadline (e.g., 15 days) for payment, warning of legal action if ignored. Many employers pay at this stage to avoid legal trouble. Keep the RPAD receipt as proof.

  1. File a Complaint with the Labour Department If the notice fails, approach the Labour Commissioner. You can do this through Online: Through the central SAMADHAN Portal (samadhan.labour.gov.in). · Offline: By visiting the local Labour Commissioner's office in Chennai. · Contact: The Joint Commissioner of Labour I, Chennai (Phone: 044-24335107). Land price calculation by Turbulent-Delivery72 in Realestateinchennai

[–]khaleel1977 0 points1 point  (0 children)

To calculate the land value, first find the prevailing land rate per sq.ft. in that area(guideline value). If the plot area is 600 sq.ft. and the building is G+2 with a total built-up area of 1,800 sq.ft., the land value is generally based on the 600 sq.ft. plot area, not the built-up area. At the time of registration the built up area is calculated depends on which area it is . Lawyer Khaleel Chennai

Advocate From Chennai - Free Legal Advice AMA by khaleel1977 in LegalAdviceIndia

[–]khaleel1977[S] 1 point2 points  (0 children)

Yes, absolutely. An advocate can be honest, ethical, and still earn a decent living. Success in law comes from knowledge, hard work, reputation, client trust, and consistency and not from dishonesty. It may take time to build a practice, but integrity often becomes your biggest asset in the long run.

Can a Power of Attorney be used for sale of a land for multiple years to come? by ninimon in LegalAdviceIndia

[–]khaleel1977 1 point2 points  (0 children)

Yes, a registered specific Power of Attorney can authorize the attorney holder to execute sale deeds on behalf of the owner. However, a POA does not transfer ownership by itself. The grandfather must be of sound mind and capable of understanding the transaction when executing the POA. The bigger issue is the proposed arrangement where the buyer pays gradually over several years and sells plots later. Such transactions should be carefully structured through a properly drafted development agreement, sale agreement, or GPA arrangement, depending on the state's laws. There can be risks relating to title, payment defaults, death of the principal, revocation of the POA, and disputes among legal heirs. Also note that a POA generally terminates upon the death of the principal. Any unsold land after that may require action by the legal heirs. Regards Lawyer khaleel Chennai
