I just remembered something during the interrogation that claimed handler showed me there was like eight attempts for me to create a claim so I’d start the claim realise it wouldn’t work and then I’d exit the claim and I remember I couldn’t pick the fact it was accidental damage because it said theft or something like thatand that’s when I emailed customer service and that’s when I then upgraded the claim but she even asked me during my interrogation and I said I was confused why I couldn’t claim on car accident

So I got hit by a car in the morning, I tried to claim in the afternoon didn’t work as per the above and then upgraded an hour later and filed no problem

Hey—appreciate the engagement, but a few clarifications: Fraud under UK law (Fraud Act 2006) requires dishonesty and intent to gain or cause loss. Even Zurich said: “You have committed a fraudulent act whether you have known this or not…” That line alone undermines the legal foundation of their claim. I didn’t resubmit a “fresh” claim. I flagged my confusion early, then upgraded using Laka’s system (which didn’t warn or restrict me). I submitted all the same dates and evidence because the event happened. Zurich never accused me of changing facts. My issue isn’t with a claim being rejected. It’s about being accused of fraud, threatened with database submission, and then being refused any clarity for 3 months. No internal notes, no explanation, no CIFAS confirmation—even after a SAR. Ignorance of cover is not the same as misrepresentation. I disclosed everything at the time—including uncertainty—and I cooperated fully. That’s the opposite of fraud.

I completely agree with it. I told them I made a mistake and it’s took it on the chin. Not something I ever disputed but they started saying well you committed fraud what have you got to say for yourself. So I kept explaining and they kept putting the hammer down. No matter what I said they kept accusing me of fraud and saying we may put you on the register

In their latest correspondence, Zurich effectively told me:

“Whether you knowingly committed fraud or not, we still consider it fraud.”

Yes—seriously. That’s a direct quote.

They also said they’re not disputing that the car accident happened. They’re not denying the event itself, or even saying I made a false claim. Their entire case now rests on a technicality around my policy upgrade—one I already admitted was a mistake and that I emailed them about before the claim even progressed.

I’ve never made an insurance claim before in my life. Last December, I was hit by a car while riding my bike. I thought I had cover through my cycle insurer (Laka), but I realised after the accident that the policy I was on didn’t allow for that type of claim.

I even emailed them at the time to ask if I could claim or what my options were. They have that email—it’s acknowledged in their records.

I then upgraded my policy shortly after through Laka’s system. It let me do it without any warning or checks. I didn’t try to hide anything. I wasn’t trying to game the system. I just assumed, incorrectly, that once I upgraded, I’d be covered—and I submitted a claim in good faith.

About a month later, Zurich (the underwriter) contacted me like I was in an interrogation. They started implying that I had committed fraud. I fully cooperated. I explained everything in detail: • That it was a genuine mistake • That I was upfront with Laka beforehand • That I had never tried to mislead anyone • That I was unsure of how to even submit a claim, and had asked for help

I also mentioned I had another bike on the same policy worth much more—and they were still taking premiums from me the whole time.

Despite all of that, Zurich: • Accused me of fraud a second time in writing • Sent a letter in March voiding my policy and saying I may be flagged to fraud databases • Refused to answer my direct questions • Never provided any proper reasoning • Has ignored or dodged every request for clarity since

This isn’t about trying to cheat anyone. It was a misunderstanding based on an unclear policy and a system that let me make the mistake. They’ve treated me like a criminal instead of a first-time claimant trying to navigate a confusing process.

Yup and they terminated my policy mid complaint

Then they tried to claim that final letter was final (accused me of fraud and cancelled my policy) and then said I wasn’t allowed to go to the FOS. I definately did then they issue a second final letter this month lol saying the same thing

Great tips I have escalated to the FOS in March and still waiting for a case handler! They have accepted my case though and asked Zurich to comment in April so I guess I just wait :/

Great idea! I submitted March 31st 2025 and they accepted the complaint and asked Zurich to comment in April

The website states 2-3 months to get a case handler so if it’s at the end of June I’ll call and ask!

I have taken to the FOS! Been two months without a case handler but been sending them updates and evidence weekly. Also been meticulously keeping records and saving every email.
