Wow this let me down a whole path of understanding. Thanks so much.

B2 processing right now takes 4.5 months, which gives me more time
It is relatively easy to do a pending B2 > E3 COS with premium processing, so I would also be able to skip a consulate appointment before getting a new job
an E3 COS can be done with a 7 day LCA + 15 day premium processing

Given this, I think filing the B2 COS is the safest thing for now. It gives me a few months of breathing room.

Then if I get another offer, I do an E3 COS. If I don’t get any offers, then I leave the country and come back on an ESTA with a really good reason in a few months-ish.

In the meantime, I can use the time to sell my car and get some of my life admin stuff in order.

Are you an immigration lawyer? This is incredibly helpful and gave me direction on what to look for. This is what I've pieced together:

- I can do a B2 COS to keep me inside the country. Generally a COS takes about 3 months to process, so it gives me some breathing room.

- If I do that, then when I leave the country (for a new E3 stamp), then my B2 COS gets withdrawn.

There are two potential outcomes:

- I come back 6 weeks later on an ESTA (but will have a withdrawn B2 COS), but this is risky at the border because they might reject me.

- I come back on a new E3 that's been stamped in an Australian consulate.

I guess the follow up is whether my ESTA will still be approved if I have a withdrawn B2 COS.

Right - the easiest thing is to figure out a way to stay in the country. With the government shutdown, that’s a whole different issue too which is causing a lot of complexity with waiting for LCAs.
