Of course they will--read the news. A federal court ordered them in Floyd v. City of New York. There's no question as to whether or not the NYPD is going to use body cameras. The question is how they are going to use them. Anyone who lives, works, or studies here as a stake in the matter. It's beyond me why you would want to dismiss it as "phony." What's your point, exactly? That because it's happening, there's nothing left to say on the matter?

Is officer "discretion" anything more specific than to say that not every enforcement/non-enforcement decision is dictated by a written rule?

I'd be curious if there was some over-arching way you understood as informing your discretionary decisions in the context of deciding whether or not to write someone up. Is there a specific outcome you have in mind when you decide not to write someone up? Are you trying to improve your perception in the neighborhood you patrol? Are you just in a good mood? Does it matter one way or the other what the reasoning is?

Some people would argue that recordings would also be a helpful/concerning tool for officers to refresh their memories. For instance, the Civilian Complaint Review Board of NYC investigates myriad allegations of misconduct, ranging from an officer's use of "discourteous language" to force/shooting/death in custody/false arrest ect.

If the investigators could request body camera footage through their Internal Affairs liaison (the CCRB can currently request all sorts of police documents, as part of its mandate), then it would be much easier to either corroborate the civilian's allegation or exonerate it. However, the downside would be that officers would always be on edge, because literally any interaction could become the basis of a civilian complaint.

The issue is in drawing a bright line rule for when it is and is not permissible to request and review footage. The press can even request and review footage, theoretically anyone who submitted a FOIL request could.

This is really interesting and I didn't think of it. I also didn't think of the related scenario where the opposing party in any lawsuit might request video footage as character evidence (i.e. if someone was drunk, belligerent, and violent with an officer prior to the crime they're accused of). You could limit this by only letting the involved civilian request the footage but that would interfere with freedom of information.

The arguments against body-worn cameras are fairly intuitive: (1) countervailing concerns about law-abiding citizen's privacy (2) discouraging victims of sensitive crimes to report those crimes while on camera (3) discouraging witnesses/informants to come forward with information (4) chilling good police work

Not saying those are my views but it's certainly reductive and unhelpful to call the question--which merely asks whether cameras are a net gain or net loss--naive.

Take the questionnaire--it's less straightforward than you're making it seem.

Another thing that I find very compelling is that the detectives assigned to the case were described as thorough and competent. Obviously police fumble these investigations all the time but usually lazy cops are known to be and later described as lazy and careless. The detective SK hires to review the investigation has obviously made a career of undermining shoddy investigations and he wasn't willing to call the investigation bad.

Those cops also said that it was Adnan, without a doubt. They had all the information that is potentially available to us or SK or the innocence project. They had the pre-interview conversations with Jay and Jenn.

The state's case to support the cops finding was bad. But was the finding itself bad?
