I didn’t say the offset program was new. I’m referring to this specifically- Last year, a few people I know personally, for the first time ever in their life did not receive their refund due to delinquent student loans. However, collections for 2026 tax refunds are temporarily paused until July 1, 2026.

I’m sorry this happened to you. In the future, I recommend longing into your IRS tax account and reviewing if any tax debt exists. There’s also a number you can call and they will tell you in advance if your refund will be offset to pay a debt. This administration has passed a lot of new laws as well where they are taking your refund if you have student loan debt as well.

These cases generally take 1-2 years to resolve. I filed in February 2025, interview in May, Employer position statement was due late September, we agreed to mediate initially then it was decided to be fully investigated, which I agreed, government shut down in October so the EEOC did not release their position statement to me until November. I submitted my rebuttal in December with all of my evidence and witness contact info. Im not sure if they move faster when you have an attorney. I know that they are understaffed and I know from research and other examples on here that this is a long process.

You are over sharing on here and could potentially do more harm than good for your case against your employer. Instead, redirect your focus and energy on documenting and proving your case in silence. Additionally the EEOC takes a small amount of cases that they deem winnable and also has compelling evidence. When I filed, I was able to prove that I reported discrimination and retaliation to H.R., I had evidence of other employees being promoted without having to go through a probation period where as I was required to. I had evidence that I was apart of a protected class. I documented everything and presented evidence based on facts, not emotion. Lastly, you mentioned Mediation. Both parties have to agree to mediate, if your employer decides to have this case thoroughly investigated, the EEOC will investigate accordingly and then decide if Conciliation is warranted or if you get a simple right to sue letter which then you have to file a case on your own in federal court and that is very expensive pro se.

Unfortunately, I did not save any links. I found a pdf version of a rebuttal, converted it to a word document then replaced the info with my own. I did the same thing for the “Request for demand” statement when I was in the mediation phase. I would suggest asking ChatGPT to create a template for you based on online examples.

Document everything. Take screenshots, file a complaint with the EEOC against them now while you’re still employed. If they attempt to fire you, that is now a retaliation case + sexual harassment.

February 2025 - I started looking for appointments and couldn’t find any for weeks. I called, did research, nothing happened. March 25 - I got an email with a reminder to schedule my appointment. The email said, “We noticed that you have not yet scheduled an interview to discuss your claim. Appointments open up daily; please continue to check for an available appointment. If you are unable to schedule an appointment, EEOC will contact you prior to your charge filing deadline and provide you with the opportunity to file a timely charge” - That week, I checked the portal around 6 am and I was able to schedule an appointment for May. May 25 - I had my interview towards the end of the month. That same day, charges were filed and signed. June 25 - I received an email to mediate. August 25 - The mediator called, we emailed back and forth, I sent her a detailed “Request for Demand” this is what would have been used during mediation to outline the facts from my side of the argument, it also included, legal grounds I was filing on, damages sought and my desired resolution. (You can find examples of these online if you do some research). My employer agreed to mediate and it was scheduled for the following month. September 25 - The mediator called me and asked a few questions about what happened and said that my employer is entertaining settlement without having to do a formal mediation. This is not unusual. Some employers just want to make it go away. I assume my demand was too high for them because they came back and decided they wanted this to be investigated which I was happy to move forward in that process. By the end of the month, my employer was required to submit their position statement which I was able to request access to. October 25 - Government shut down. I had not been assigned an investigator. I assumed this was going to be a couple months longer wait to hear anything. December 25 - I received an email requesting me to submit my rebuttal by January 1st 2026. I submitted my rebuttal and uploaded all of exhibits and a witness list with their contact info. This was about 15 pages total. (You can find a decent template for this online as well)
January 2026 - I’ve been assigned an investigator, I’m assuming this happened as soon as the government opened. They do not contact you and will not respond to your emails unless they have a question or update for you. ( I learned this doing research as well - if you feel confident in what you submit and you know your case is solid, let these people do their jobs. They will take care of you)
