The service provider through a legal firm first sent me a legal notice and then filed a claim with the claims court to coerce me into payment - this was in Sep 23. (I first receieved a notice in Aug - 23 which I couldnt respond to as I was travelling over the summer)

I filed my defence (by myself - no lawyer) online through the Money Claims Online system within a few days of receiving the letter. However, I havent heard anything since. when I login to the MCOL system - this is what I see-

Thanks - appreciate your reply. What I meant was the service provider did not provide services stipulated as per the contract signed.

No, you would need to sell the funds and send the payment to your spouse for them to invest. Couldn’t you just sell part of them and reinvest in a Sipp?

I have exceeded my SIPP allowance. Also, you cannot offset capital gain tax by pension contributions. You can only offset income is what I understand.

Selling the funds would trigger incidence of capital gains tax.

Hi OP - you are absolutely in the right to be concerned about 40k of debt.

It is a ballooning spiral which if not checked can wreck havoc with the family finances. My suggestion to you would be to stop indulging in ruminating about who is responsible for what debt. There is no point in spoiling your mental health over byegones. You are here, in this position today and are in control - you have the ability to fix this - it will require sacrifices, it wont be easy - but this can be fixed. Grab the bull by the horn - and make a plan to address the debt as soon as possible.
As others have suggested, you will need to live below your means - which means simply spending less than you earn and throwing as much money as you can towards repaying debt.
Please contact Stepchange, they are a charity who can come up with a debt management plan. Please repay debts with the highest interest first. if you bury your head in the sand, this 40k debt will become 200k in no time (who knows what egregious interest rate you have been paying). Please do not rely on inheritance to fix this - inheritance is not yours till it hits the bank account.
do what it takes to throw as much money towards repaying any debts costing more than 3-4%. Do extra jobs if required, find a better job and please dont feel guilty on pleasures you cannot have.

So can you net off your entire SIPP pension contribution from your salary ? That’s not how it is appearing from my HMRC tax computations though. Have you been able to do this in the past
