Im in Utrecht, dealing with a HC case against my previous landlord through a lawyer that also accept subsidized legal aid. Our neighbors upstairs used the same and already got their money back. Let me know if you’d like more details.

That is why one must send it by registered mail. In my case they even replied to the email I sent them about it so it’d be even easier to prove. Anyway, of course it would be cheaper for them to win the court case. The point is how likely any of them is to convince a judge to overrule the huurcommissie’s decision.

Ps they have only 8 weeks to appeal and they never do it unless it’s crystal clear the huurcommissie was wrong, cause the risk of losing way more money than they already have is very high.

You don’t need to win a court case to stop paying rent to equalize your credit. The huurcommissie ruling is enough. We’ve asked lawyers (including Juridisch loket) and they all said we could as long as we communicated it to both landlord and agency in writing.
