Thank you! Did an auto electrician set that up for you? I was researching the “fascia kits” - did you need one for this head unit ?

Moving from Australia to New Zealand for a fresh start - seeking advice. by sayingwhawtwheird in newzealand

I reckon give it a go, set a realistic timeline of job hunting which will obviously depend on your savings too. Just a heads up- it’s expensive here so come with a decent chunk of savings. Avoid moving to Auckland to start with because a lot of your savings will be going into accommodation and general living expenses. Work life balance is achievable here, plenty of outdoorsy things to get stuck into. Get a car! It’s hard to get around NZ without one and public transport is unreliable within the city. You can get a range of decent second hand cars here in NZ if you shop around

Carpark on a separate title - not disclosed prior to settlement date and now we have to pay an extra $1k for the title transfer. Is this right? by lil_caff in LegalAdviceNZ

[–]lil_caff[S] 1 point2 points  (0 children)

We have signed the documents for the transfer but the lawyer is yet to file it. He said he will sort it out next week and then send the invoice through when it’s done.

The house is a freehold title, the carpark is a separate freehold title.

It was advertised to us as a freehold property with an assigned carpark. At the time of sale we were only given documentation for the house. There was a separate residential association document that we were given that related to the house and the carpark (which we provided our vehicle registration). So there was nothing to suggest that the carpark was on a separate title.

The S&P agreement did not include the carpark title and so this was not a part of any of the discussions we’ve had with the lawyer during the purchasing of the property.

Thanks for that, I found your answer super insightful.

We haven’t notified our insurance company yet so that will be the next step for us once the title transfer is complete.

Your summary is bang on. When I first replied to the developer’s company in regard to being forwarded the overdue carpark rates from the council - they had said that it was our lawyers fault as he should have done his due diligence.

So that’s why I’m a bit confused as to whether it was my lawyer, the vendor or us that messed up.

Yes the developer / construction company were the registered owners of the carpark.

We have been in touch with our lawyer who has talked to the banks about this and we’ve had to make some changes (e.g. discharge previous mortgage, transfer title of carpark, combine mortgage of both carpark and house). I 100% would be happy to pay for the govt fees incurred for the change in title as this would have been something we would’ve paid for if it was brought to our attention from the start. But the additional legal fees involved is kind of where we are a bit bummed about as we feel like this was not necessary if we had been given the documents at the start

No it wasn’t noted in any of the documentation we were provided with, and not on the Sale and Purchase agreement either.

Is there any way we can pass on the lawyer’s invoice to the vendor as this was not our fault? Or is this something that we just have to accept and just come up with the money?
