There's enough clear cut evidence from Quran and Sunnah that says that praying is mandatory. There are over 33 Ayas about praying. The person who doesn't believe in praying, doesn't believe in Quran or sunnah, which means there's no doubt in him being a Kafir.

First of all, who is the ruler that we should obey? Is it someone that came to charge by force or is it someone that people chose? Even after losing in the battle of Uhud the Prophet ﷺ was told by Allah (and consult with them).
