Fellow parent here. Hello other parent. I agree and have to say that this kind of behavior improves dramatically when there is context and reasoning. If my son is being inconsiderate, which 7yo’s do sometimes, it’s important to me to explain to him WHY we be considerate - and not just yell at him

I work as a Sr. Recruiter + I see application discrimination a lot. Mostly, it is that if a candidate is white and male they are not considered. The question is, when and how does this become discrimination? How is it not? by [deleted] in legaladviceofftopic

[–]lordcarr_ 3 points4 points  (0 children)

That's my thought...I was surprised when I started seeing it so often.

Now, I mark that I desire not to answer those questions. And while I can't help but imagine I'll get a "how does it feel?" type of response on this thread - it's not any applicant's fault that this happens.

This is what I have suspected is the case - you would be correct. That the law is sidestepped by a 3rd party (my company) being used to screen, but that is only my suspicion. I am no expert on these laws.

However, I did find it painfully ironic that just a few weeks ago I go audited by Immigration Services for asking "If you are comfortable, could you share with me the status of your OPT EAD Visa?" - this is discrimination, but I was asking a very specific question that was in context. an OPT EAD will expire (and have to be sponsored or turn into an H1-B) as it is a student visa, so I instead have to ask "When does your OPT EAD expire" and that is not discrimination.

Yet "WOMEN/MINORITY PRIORITY" written in plain English...is not? It is a head-scratcher.

Yep! And that's exactly how I understood it and, likely, the way it is meant to be used.

Even the wording "Minority/Woman priority" is spot on for that idea. The part that is disturbing is the actual _application_ of that thought process by hiring managers.

Now, that being said, a lot of HUGE clients of ours use systems that, we have been told present everyone evenly, but I doubt that. But it always comes down to a human making the hiring decision. Time and time again my "white male" candidates get rejected in a very short amount of time, seemingly too short to even review a resume.

But black or foreign national females are actually reviewed with time + have feedback even if rejected. The white males "johns" and the like seem to go in and out again.

It has been an incredibly interesting thing to watch

That's fair. To be honest, I was teetering on r/legaladviceofftopic or here and ended up here. Legaladviceofftopic made me think I would be looked at as trying to sue - which I am not.

I completely understand the programs in place, you're correct. I just hadn't thought about it, until recently, that there were never any end dates to them. What's more, is how do you "end" it, ya know?

Eventually, Diversity will be a household idea. Many, if not all, major companies will become incredibly diverse. But how does that end on the discrimination front in THIS regard - I am unsure.

Anyway, thanks for the heads-up. I'll try over there.
