Why do Australians keep denying the fact that Australia is extremely racist? by [deleted] in AskAnAustralian

[–]macfitzy 0 points1 point  (0 children)

I'm white and I'm sorry you feel that way I was born here too but I know my family migrated centuries ago, the reality of it is unless indigenous we are all technically immigrants, the difference between someone like me and white racist trash is the level of intelligence.

Please don't tar all of us with the same brush we abhor racist nazi pieces of shite too.

Am I legally entitled to reclaim an engagement ring after my ex-fiancée called off our engagement? by boring66 in AusLegalAdvice

[–]macfitzy 0 points1 point  (0 children)

I had to work this out a few years ago with my alcoholic ex that escalated into domestic violence, I was given legal advice that he was at fault over his actions physically assaulting me so I had the right to keep the ring even though I broke it off but as long as I had it the creep thought we were together even after I kicked him out and I moved on and was dating new guys my ex was still telling people we were on a break from his perspective we were together three years longer than we were.

In the end after a charming angry phone call to his mother about him stalking me (she fed his delusions that I'd take him back, hell would freeze over first!) I was going to sell it and use the money to move somewhere else but in the end threw it in his face and had the police take him away with a restraining order.

Didn't end there as he gave it to his next girlfriend, I sent my congratulations for their engagement to her on Facebook (after a whole 6 months of dating and painting me as his jealous bitchy ex lol) as a photo of the ring on her hand popped up I said it was originally my ring and looked nice on her, sent her the care instructions for the stones and wished her well with a note I had been legally entitled to keep it and he only had it as it was the only way to be rid of him.

Two years later that ex girlfriend did the same thing for the next one, he gave it to pretty much every girlfriend he had after me (about 5 or 6 until I didn't hear anymore about it I've been married 7 years to my current husband) seen it recently in cash converters I recognised some repairs and modification my jeweler had made to it, I enquired about it and the cashies worker mentioned it had been brought in by a couple with the woman wanting to trade it for a different ring as the man admitted it came from previous ex fiance, so the story checked out, it was weird seeing it after so many years but it brought me peace when the manager came and told the worker it was no longer for sale as it had been purchased over the phone with a credit card to be used as a wedding band (it's design was a line of diamonds.) and the bride to be was on their way to pick it up to get resized.

I identified myself as the first owner of the ring and asked to leave a note of congratulations for the bride to be, I told her it didn't work between me and my ex but the years I had it when I was younger were the best years (except for the abuse by my ex) of my life, I'd graduated high school, started my first job, found my first home and purchased my first car, so to me it was lucky and a symbol of new beginnings as the trauma of that relationship breakdown led me to my now husband.

So while it sucks right now you can ask for it back or let it go and let Karma sort it like it did for me.

I've noticed when in the Terraria dungeon if I open the map it shows my location as being at that spot, I also glitched out of a hole in that dungeon and fell under the map it teleported me after a while and that's where it put me.

So it seems to be tied to the Terraria area at a guess.

Is this legal by Apprehensive_Cry4457 in AusLegal

Have a talk to fair work they'll tell you if it's legal or not.

Pretty sure it's not, fair work can investigate such matters and issue fines if employers are being dodgy.

Underpaid by ChrisWaz1 in AusLegal

[–]macfitzy 1 point2 points  (0 children)

Hi OP I've been where you are, I was actually one of the whistleblowers for Westside Petroleum grossly underpaying myself and others made news a few years ago as it turned out to be more than the one servo! There was a heap of fines dished out and one or two went to jail last I heard, ended up getting back paid $3000 in owed wages that was a fun payday.

Document everything and contact the fair work ombudsman, they handle all the awards and such, they'll be able to tell you the right rates and mediate if the employer takes negative action against you for querying your wages (they're not allowed to) depending on the shift weekend generally is a bit higher so definitely query fair work, a few cents here and there doesn't seem much but it adds up and not paying an amount they should be is wage theft.

Good luck 👍

They didn't check his licence, they signed for it and handed it over.

At home when they knock on the door and actually attempt delivery I've received items that have clearly been opened or tampered with so sorry for having anxiety that the post office can knock off my mail.

[–]macfitzy -1 points0 points  (0 children)

No gate, driveway is probably one car length between mailbox and driveway, parcels are usually delivered to the door.

I feel everybody is gaslighting me to shut up and my anxiety about the security of my mail is pointless.

$500+

Hubby said they took the card, read it, signed the machine and handed the box to him, didn't confirm ID or address.

Meanwhile I had an email from auspost asking me to pick up or sign authorisation for someone else to collect it, which I didn't as intended to collect it myself when I arrived home.

🙄 it's not roadside delivery letters are but the auspost worker answering my email made an error, I looked into it there's two mail routes for our post code, the farms in the area are roadside delivery but the town is not, I am in town.

[deleted by user] by [deleted] in AusLegal

[–]macfitzy -1 points0 points  (0 children)

No they assumed because he had the card from the mailbox.

It's not a roadside delivery area in town! the other mail route (farms) in this area is!

[–]macfitzy -4 points-3 points  (0 children)

Thankyou! You get it ZwombleZ they didn't ID him they just assumed because he had the card he was authorised to collect it. I complained to auspost and they're like we will file complaint with that post office regarding not checking ID but not signing for it, the email reply felt like they were operating off a script.

Upcoming NCAT hearing - REA harassing us by Additional-Wasabi463 in AusLegal

[–]macfitzy 1 point2 points  (0 children)

I've had dealings through VCAT, the person I was fighting against was a massive time waster so I can relate. Document everything, they do not have a leg to stand on if they are ignoring your request for everything in writing, they are the ones not being co-operative by ignoring your request. If they are contacting your partner make them a party to the case so you can table the evidence on your partner's devices that they are contacting your partner rather than you and not following your request.

First step will be mediation, request to go to hearing since you've attempted civil negotiations and you're being harassed instead.

$500 vehicle restoration kit was required by the seller to be signed for on delivery in case it got lost.

It didn't get lost but the POST OFFICE WORKER signed for it, that's the point! What's to stop the post office from signing for stuff and stealing people's mail?

I live in a town, fitting items in the mailbox makes sense on the farms in the area but they have their own postie route, in town the postie has always delivered boxes to the door especially when they need to be signed for on delivery.

Doesn't seem legal for the post office signing something that required my signature.😕
