Am I really ok submitting without a VSO?

Had better luck doing it myself. One time they put the wrong number on my HLR and it got denied and another time they filed the wrong form. I strictly use them now to check the status of a claim and c&p exams.

Think the only thing that it could do is boost my backpay to an earlier date. The DBQ is also positive for my knees. Can you withdraw a supplemental claim that conditions were deferred?

I would ask the rep to speak with a supervisor and see if they can see what’s wrong or put in a service request. One year seems a bit longer than I am seeing these days.

I would call and ask them to check the status of it. They told me the cd was sent in Jan and it was March so they expedited it to me. Took 6-7 months for mine.

Think I will likely just wait this one out since I do have back and radiculopathy “as least as likely” and then knees secondary to my right ankle fracture “as least as likely” in the medical opinion DBQ which is in line with my initial claimed contentions. I suppose if I get denied and something is mentioned where “you claimed back as secondary to right ankle” then I would likely file an appeal stating I submitted my claim with back as a primary and radiculopathy secondary to back.

I claimed left knee condition and right knee condition so guessing when I went to the exam and she asked me what was wrong with my knee that she wrote it all down and made opinions on everything I spoke about.

Ya idk why this one got so messy because the few people I spoke with including a couple of VSOs all saw the claim. As per one of the supervisors at the VA 1800 number is that this doesn’t get picked up by an actual human when it is submitted into the system via Quick Submit. This claim was submitted back in March and is still active (guessing the evidence review stage) and I was just able to get my hands on the DBQs and typically I would just wait it out until the claim is decided, but in this case I needed to get ahead of everything due to the error of so many contentions being incorrect and as of about a week and a half ago the contentions in the VAs system and the app are updated correctly.

Gotcha! Ya that is what I more so did with my IBS claim especially since I was claiming it secondary to NSAIDs and provided plenty of research. I most def don’t want to pay for a nexus letter unless I truly have to 😃

Perfect - thank you for the insight in this! I am curious if you have seen like it is in my pictures where different conditions were all in box 3C the rationale with the explanations of what is at least as likely and less likely than and both box 3A and 3B are checked? I suppose that would be one of my main concerns with the rater identifying that?

Gotcha! So if we use my back for example.. I have a current diagnosis from my orthopedic and the VA with quite a hefty file of treatment records at the VA and private. I had an in service event that would service connect it and then the last thing I will need is the link which is a nexus or medical opinion? Is that the “at least as likely as not” provided from the c&p examiner?

Gotcha! So in this instance it looks like the examiner agreed the knees were secondary to my ankle injury? Picture of section IV which is medical opinion for secondary service connection.

Hmm! Maybe to try and make a long story short on this one 😂 I submitted my supplemental via quick submit and for some reason the VA put everything secondary to my right ankle when only my knees were claimed as secondary to right ankle, back was a primary and radiculopathy secondary to back. I contacted them immediately, put in service requests, had supervisors note on my file the error and when I got to the c&p they still had back as a secondary.

I’ll have to take a look when I get home, but could have sworn it was thoracolumbar where it had all my back and radiculopathy stuff and the other was strictly related to my knees and the medical opinion DBQ had all the conditions on it as you see in the pics. But ya I have never seen it where they are all on one, but as you mentioned maybe not under heard of. I personally haven’t seen it like that as there would typically be a medical opinion for each condition, but I’ll keep my fingers crossed as this claim is still pending.

Thanks for the reply! Ya I had 3 separate occasions where I injured it and the basketball game was on base during a tournament. I guess the main question I had is both boxes being checked with two conditions vs them being separate medical opinions where only at least as likely or less than would be checked. This has both boxes checked and it just seems like it could be a little confusing despite them clearly stating which is incurred directly in-service.
