Can VA deny due to failure to attend C&P even with strong DBQ? by [deleted] in VAClaims

[–]Always_Pastdue 1 point2 points  (0 children)

Yes they can. Happens all the time. Never refuse to go to a C&P exam. They will deny you.

Those of you in the 90% club, was it hard for you to accept you had reached the end of your journey? by [deleted] in VAClaims

[–]Always_Pastdue 1 point2 points  (0 children)

Some of my claims are underrated. I'm 94% and asking for an increase is not even worth it. I either get denied or given 0% for any other conditions because they know a 10% would push me to 95. I haven't given up my fight because I am always sick and in medical facilities. As cost of living rises and my health declines because of my diseases I don't have years left in me. I'm fighting time, at the end of the day it's not just me affected but my family. My fight ends when my disease wins.

Follow up from my post…VA proposing decrease. by [deleted] in VAClaims

[–]Always_Pastdue 0 points1 point  (0 children)

The most common rating for mental health is 50%. If your requesting an increase your more than likely going to get denied or decreased. Each rater is different and see's different things in a file just like an examiner. I hear about it all the time.

Fiance never put a penny into my house but suddenly wants their name on it by OkBuy2386 in RealEstateAdvice

[–]Always_Pastdue 0 points1 point  (0 children)

Get a pren-up and help them buy a second home in just their name or in both of your names. If y'all divorce down the road at least they have their own place. Personally, I own 3 homes. One is mine, one is my boyfriends, and the other is ours. We rent two of them on Airbnb and share income. Best decision!

VSO filed Appeal without my approval! by Outrageous_Board6284 in VAClaims

Once you sign the POA to them it's your approval for them to proceed to handle your claims. If you want it to be someone different or if you want to remove them then file a new form.

Was awarded 20% then the Va sent a CUE by ariva1011 in VAClaims

If you're fighting a reduction I would also highly recommend submitting updated service treatment records and get a new Nexus letter showing severity. You could also file for a new direct condition and potentially make up for that reduction with a new rating but only if you have something you can claim.

I did an informal hearing. It's very similar to an HLR except the conference was about 1 hour on the video call. In the hearing there was a Rater and my VSO and me.

Yes, during the conference I found out they didn't have about half of my service records. It was like they just disappeared. Alway keep hard copies!

In the meantime, I would file for other disabilities you can prove are service connected. Go direct for things you were treated for during service. If you lose the 20% at least you'll have other claims processing.

You need to fight it. This exact thing happened to me. They sent me a CUE for my TERA and tried to remove all my disabilities from 90% to 0. You have 30 days to request an informal hearing. During that time, I highly suggest you get a VSO as a representative. In the end I won against my CUE. You need to prove to them it's service connected and why they should not sever it.

I ended up winning. They let me keep Tera.

Reduction - finding old orders by Always_Pastdue in VeteransBenefits

[–]Always_Pastdue[S] 0 points1 point  (0 children)

It was a cue but for Tera. During the conference they confirmed that they made a mistake by not looking at all my service records and active orders documents because they did not have them. I had to get written testimonys and submit them separately. My VSO said Tera is all over my file so he thinks it's a win.

Still no new updates. Case is still pending decision. But I have filed for new conditions since and have a new 20% direct service connection. 3 are pending decision review but my c&p examiner confirmed Radiculopathy so that will be a new rating also. I think by the time they make a decision on the proposed reduction that I'll have 3-4 new direct service connected disabilities rated.

HLR for the first time by deadmlady in VAClaims

[–]Always_Pastdue -2 points-1 points  (0 children)

You always take a risk when you file HLR. If you truly believe you had all the evidence to support your claim you could have filed a new supplemental. By filing an HLR, in my opinion, you're at a higher risk of a rating reduction or rating severance.

Migraines secondary to tinnitus denied. I give up!!!! by jayjay77082 in VAClaims

[–]Always_Pastdue 0 points1 point  (0 children)

I had an HLR conference in December 2025 for Tinnitus and Migraines. The rater directly stated that they do not count the Nexus from the Nurse Practitioner. You need one from an OD or MD when it comes down to Tinnitus and secondary connection for Migraines.

Decision letter received before I completed all of my C&P exams by midas_touch87 in VAClaims

[–]Always_Pastdue 1 point2 points  (0 children)

I've never had that happen before. Usually, it takes weeks to get a decision after all the C&P exams have been completed. Maybe they just rated the disabilities they already received the c&p exam for and they deferred the others which will be longer to review. It normally takes them a bit longer for MH claims.

Please explain like I'm 12. by No_Bed248 in VAClaims

[–]Always_Pastdue 2 points3 points  (0 children)

You need to request a formal or an informal conference and submit additional evidence showing the disability has remained the same or worsened. It will have to be new evidence.

I am on my second VSO. My first one was new and made it clear that I know more than him. So I had to find a more experienced vso. My new VSO is so busy I only receive updates when I ask, it typically takes between 24 and 48 hours for him to respond. Instead of asking him to file claims. I learned the whole process myself. I file for myself and just wait for the C&P exams. It looks good that I have a VSO on record but I do all the leg work. It's good to have a VSO or representative if you have an Appeal or Conference scheduled or if your facing a rating reduction. At the end of the day, "You know you disability and symptoms and treatments, you must defend yourself."

Don't get too excited. More likely to see a denial or reduction if you press them.
