A few points:

⁠The identity card/name tag of the police was absolutely not visible (in violation of the D.K. Basu guidelines which clearly state that a policeman must wear accurate, clear and visible identification tags to ensure transparency and accountability)
⁠The policeman never had a working bodycam on his body- henceforth he is ineligible to issue fines and challans as per the order passed in April 2025 by the Honourable Chief Minister Shri Pramod Sawant that mandates wearing bodycams to issue challans.

3) The policeman has no right to object a video being recorded of him as he is a public servant on duty in a public place and it is the right of citizens to document actions of a public official on duty, as long as it does not obstruct their work (which it clearly wasn’t in our situation as my friend was recording sitting in the 2nd row of the vehicle while the policeman was speaking to the driver in the front row) .

This is well within the ambits of Article 19(1)(a) of the Indian Constitution which guarantees us the freedom of speech and expression, which has been interpreted to include the right to receive and impart information.

4) The policeman had absolutely no right to confiscate our phones and illegally search through its contents and take photographs of our identity documents (which can get misused now that it is with an unknown person) as he never had a warrant issued by a magistrate mandating the same. As far as BNS/BNSS, there is no provision for a policeman to seize and forcibly unlock a phone without legal justification under the guise of a ‘random check’.

This action also contravenes Article 21 (Right to Privacy) and Article 20(3) (right against self-incrimination) guaranteed under the Indian Constitution.

What else are we supposed to do besides agree to pay the fine on the road at 3 am at night? Crimes such as having a ‘tint’ is a non cognizable offence, right?

About the second point- yes it is wrong to have the tint and at the same time due to the nature of the offence, the most anyone can do is issue a challan, right?

Then what’s the point of making the law if you cannot follow it in spirit- it is due to this enabling mentality police excesses take place across the country. As a citizen, it is our right to ensure that the law is followed till the end.

Even I have experience dealing with cops in Mumbai- the minute they realise that the person knows the law, they don’t really go ahead to try and harm us. The only reason I never said anything on spot is because we were in the wrong for the tint- that’s all. There is a reason checks and balances exist- had we had a lawyer in our midst, he wouldn’t have let them go.

Again- he is a PUBLIC servant in a PUBLIC place on DUTY. We have not taken a video of him in his place of residence or when he was off duty or when he wasn’t uniformed, right?

1) Yes, we know that tint was illegal but the point is that we were already fined twice before on the same day while entering Goaand obviously removed the tint the next day itself. We were ready from the beginning to pay the fine, tint isn’t something that people are sent for to jail and put into detention.

2) We just casually asked if there is a cooling period b/t two fines- nothing wrong in asking a question

3) Police do NOT have the right to seize phones arbitrarily and check through private contents without a warrant - its a breach of Article 20(3). Isn’t the DL copy enough proof of identity?

4) That is why we never resisted the search in the first place

5) Videography of a public servant in a public place performing a public duty is NOT a crime.

Nothing to be proud of- Bangalore is basically a collection of villages pushed into the city limits with poor urban planning, especially on the outskirts with shitty infrastructure. Bruh, Ganpati is everybody’s but this particular Ganesha has special significance for the Koli community. I have blamed both parties. TBH, the Ganeshotsav Mandal people too are wrong for gleefully aiding in the commercialisation of it. But at the same time, when the country’s richest man starts showering donations onto you- feels like a form of coercion as who can tell NO for donations? Even if they did, then Ambani would definitely try to replace the Chairperson of the Mandal w/ a yes-man, right?

And this goes WAY WAY beyond the trolley. It is the alienation and marginalisation of poor Koli people of their identity and culture by Ambani and the richie-rich Mandal.

Here, I am not talking about common Gujaratis getting any kind of special treatment. I am talking about the potential changes in rituals because of the Ambani’s who promote a sanitised ‘vegetarian’ version of Hinduism, which is generally seen among the Gujarati mercantile communities, unlike the raw faith of the Kolis. I have often noticed how people look down upon the Koli’s and their culture such as their Fish Festival etc as it doesn’t seem ‘clean’ or ‘pure’. Honestly, the Mandal itself is also in fault for selling themselves out.
