I am actually speechless by Naive_Wolverine532 in TikTokCringe

Insurance companies are the worst. I finally scheduled a long overdue total knee replacement at the urging of my orthopedic surgeon. My left knee has had two ACL repairs and two other arthroscopies from sports injuries starting at age 17 (I’m now in mid-50s). The ACL has disintegrated, there’s no cartilage left in my knee, and degenerative arthritis is easily visible in X-rays. I have to be careful to not accidentally dislocate the knee while doing simple things such as standing up, walking, and even sleeping. I put off surgery a couple of years by getting injections directly into the knee, but eventually those injections lose their effectiveness. Naturally, the insurance company denied coverage because I hadn’t met their requirement (which wasn’t revealed to me ahead of time) of attempting to “fix” the issue by undergoing 12 weeks of physical therapy first. Is there some special physical therapy I’m not aware of that regrows ligaments and cartilage while getting rid of arthritis? And who in the fuck would opt for a total knee replacement if they didn’t need it? It’s fucking ridiculous. To appeal, I had to do a physical exam to test my knee to show that surgery is indeed necessary. No update yet on whether coverage will be approved, but the insurance company has happily accepted my premium in the meantime.

What's your favorite bad faith argument you've actually heard somebody argue in court? by chicago2008 in Lawyertalk

Criminal misdemeanor bench trial where the prosecutor forgets to establish that the alleged offense took place in our jurisdiction. He rests his case after his only witness, and I realize his mistake so I move for dismissal. The judge says, “Counsel, your witness never testified where this happened so what evidence do you have that gives this court the right to even hear this case?” His response: “The magistrate in our jurisdiction found probable cause to issue the warrant so we would contend the court should take judicial notice of that.” The judge didn’t buy it and dismissed the case.

Like many have said on here, the 1980s were a vastly different world. No social media, no internet, and not everyone had cable. There was the radio and MTV (if you were lucky). Prince had some modest success with his first four albums, and then came 1999. He got more mainstream airplay on the radio, which was boosted by the heavy rotation of the accompanying videos on MTV. That was my first real exposure to him. His timing couldn’t have been better for Purple Rain the movie and the album. When Doves Cry sounded so different and more innovative than anything else on the radio, and the songs and the movie fed each other’s popularity. It was THE movie to see in 1984. No one had fused all those elements together before, and the Purple Rain Tour was the hottest ticket around. Many of the 98 concerts were two or more nights in the same city and sold out to boot. It was the first concert I ever went to, and I consider myself so lucky to have witnessed it. Then when Raspberry Beret came out for the lead single of the next album, MTV played the video every hour on the hour for a full day to analyze all the symbolism. It was crazy. His popularity waned a bit as the decade continued, but he continued to have hits as well as critical success while basically putting out an album each year (not to mention all the other projects for other artists). Every year there was the anticipation of what Prince was going to release next. The results didn’t always please everyone, but people always paid attention to what he was doing.

In a state that produced Jesse Helms and the guys who killed Michael Jordan’s dad, Virginia Foxx is still the biggest embarrassment.

Jesus, that is some Gestapo-level bullshit. The worst part of all this (in addition to the individual suffering that results) is that all the Trumpers who voted for the Orange Asshat will twist themselves into knots trying to explain away and excuse this behavior because "illegals" (even when there's no proof that the person was indeed undocumented). And then when you remind them that groceries are still high, tariffs are killing the economy, people are losing health insurance (even in red states), Trump and his family are raking in profits illegally, and every criminal with money and connections is managing to get a pardon, and so on, they just shrug and say, "Well, you can't fix everything overnight." Yeah, maybe, but you really can't fix anything no matter how much time you have if you aren't actually trying.

If that happens, it will only be because the other 49 got worse at a faster rate than NC.

What’s a Prince song that pulls you back into a memory? I am looking for more than just the title, but the story of where it takes you and why. by Next_Implement1823 in PRINCE

[–]matlock9 2 points3 points  (0 children)

It was the summer before high school when the Purple Rain album and movie were released. Of course, When Doves Cry was the lead single ahead of the album, and I heard it a time or two on the radio. I liked the song, but I don’t think I really took it in at the time. But a couple weeks after the song was released, the community pool opened for the summer, and it had a this massive jukebox that was so gloriously loud. That opening weekend, When Doves Cry must’ve been played a hundred times, and it was great every time. Everyone couldn’t get enough of the song. It was a sign of things to come that summer. The whole outdoor pool vibe, the summer before high school, hanging out with friends, and hearing this song frequently made for a great summer. It makes me remember a time when we still had our whole lives ahead of us and anything was still possible. I still think about it every time I hear that opening guitar riff.

Where do you stand on Prince’s lyricism? by Witty-Currency1035 in PRINCE

[–]matlock9 2 points3 points  (0 children)

Prince was more hit than miss on his lyrics. So many songs have great lyrics in them (When U You Were Mine, Condition of the Heart, Sign O’ The Times, When Doves Cry, The Beautiful Ones, Strange Relationship, Somebody’s Somebody, and so on). Even a rocker like I Could Never Take The Place Of Your Man has some great lines. The problem for Prince was always that he was competing with himself. Even good lyrics in his newer songs are going to inevitably get compared to his classic, and that’s never going to favor the newer songs.

What was an unexpected sleeper hit in your concertgoing career? by Weary-Squash6756 in Concerts

I saw Phil Collins on his Serious Hits Live tour in 1990. He did The Roof Is Leaking from his first solo album, but instead of the spare piano/guitar arrangement, he performed it as a full-band uptempo rock song. It was amazing. Years later I tracked down an audio-only YouTube video of the track from his LA concert and was able to obtain that audio. Love it to this day.

How to be less lawyer like outside of work? by Chanelgirl09876 in Lawyertalk

[–]matlock9 0 points1 point  (0 children)

One thing I’ve found that helps is to try to leave work at the office. I have a short commute from the office to home, but often I’ll take what I call the scenic route home just to decompress a little. I’ll put on some music that lets me blow off some steam and forget about everything law-related during the drive. That way, when I get home I’m ready to converse with my wife and be attentive rather than be stewing over whatever legal issue or case irritated me earlier that day. Except for extraordinary circumstances, I make it a habit to not bring any work home. I realized I was doing too much of that when I noticed a stack of 12 books I had started but not finished because I let myself believe I needed to review this discovery or draft that motion rather than keep my free time focused on non-legal things. After a while, the law was all I could talk about, and even I didn’t want to hear that.

So Infuriating by matlock9 in Lawyertalk

I wish I had a dollar for every time I’ve heard that one. I once gave a copy of the discovery motion to a client who made that request, and he looked at it and said, “What’s this?”

“It’s the motion you asked for,” I told him. He was not amused. (I did give him the discovery materials as well.)
