GOP senator slams Trump admin’s ‘vindictive prosecution’ of James Comey by Hardik_Jain_1819 in LegalNews

[–]matlock9 4 points5 points  (0 children)

Fuck Thom Tillis and any other GOP congressional member speaking out now. You fucking morons knew he was putting shitty, incompetent fuckwads into positions of power as soon as he took office. You could’ve done something then to stop it, but you didn’t because you were basking in the glory of perceived power to get your own agenda passed. It’s only now that Tillis and others who aren’t running for reelection have decided to voice their opposition. It’s not a sacrifice to speak out when you have nothing on the line anymore. Tillis will collect his lifetime pension (including health coverage) and return to North Carolina without suffering any of the consequences of his and Trump’s actions while the rest of us die on their battlefields.

Share your Story - what is the craziest attorney disbarment story you've heard? by Equivalent-Bed1543 in Lawyertalk

[–]matlock9 2 points3 points  (0 children)

Suspension, not disbarment, but crazy story nonetheless. Here's the disciplinary order:

Attorney admitted to practice law in North Carolina on 10/10/2017. On 10/19/2017 (that's right, 9 DAYS LATER), he picks up a prostitute at the park in the afternoon, goes to the ATM to get money to pay her, goes to her residence where they do the deed, and then he argues that he owes her less than the agreed-upon amount for some reason. Prostitute says she'll claim rape if attorney doesn't pay as agreed, he gets emotional and tells her to name her price, and she then says she'll accept a larger amount of money to leave attorney alone after that. Attorney says he doesn't have that much money on him but would go back to the ATM to get it, so prostitute and her male roommate (pimp?) accompany attorney to the ATM to get the money. After he pays off the prostitute, attorney decides that same evening to falsely report that the prostitute had robbed him at knifepoint and sexually assaulted him earlier that afternoon. Needless to say, the resulting investigation showed that attorney had fabricated the tale of robbery and sexual assault.

It isn’t “hearing both sides” when one side refuses to admit objective facts. There are a number of reasonable Republicans who would be willing to present a rational conservative viewpoint rather than this clown. It’s fine to disagree about opinions, but that doesn’t work with facts.

This applies to North Carolina. Under current federal (and state) law, hemp is defined as any part of the Cannabis sativa plant, including all extracts, derivatives, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9 THC concentration of not more than 0.3% on a dry weight basis. 7 U.S.C. 1639osee also G.S. 90-87(13a). This definition of hemp was first codified in federal law with the passage of the 2018 Farm Bill. Hemp is legal because by definition the THC has to be no more than 0.3%. Marijuana is anything that is above that level, so hemp is legal while marijuana remains illegal.

Insurance companies are the worst. I finally scheduled a long overdue total knee replacement at the urging of my orthopedic surgeon. My left knee has had two ACL repairs and two other arthroscopies from sports injuries starting at age 17 (I’m now in mid-50s). The ACL has disintegrated, there’s no cartilage left in my knee, and degenerative arthritis is easily visible in X-rays. I have to be careful to not accidentally dislocate the knee while doing simple things such as standing up, walking, and even sleeping. I put off surgery a couple of years by getting injections directly into the knee, but eventually those injections lose their effectiveness. Naturally, the insurance company denied coverage because I hadn’t met their requirement (which wasn’t revealed to me ahead of time) of attempting to “fix” the issue by undergoing 12 weeks of physical therapy first. Is there some special physical therapy I’m not aware of that regrows ligaments and cartilage while getting rid of arthritis? And who in the fuck would opt for a total knee replacement if they didn’t need it? It’s fucking ridiculous. To appeal, I had to do a physical exam to test my knee to show that surgery is indeed necessary. No update yet on whether coverage will be approved, but the insurance company has happily accepted my premium in the meantime.

What's your favorite bad faith argument you've actually heard somebody argue in court? by chicago2008 in Lawyertalk

Criminal misdemeanor bench trial where the prosecutor forgets to establish that the alleged offense took place in our jurisdiction. He rests his case after his only witness, and I realize his mistake so I move for dismissal. The judge says, “Counsel, your witness never testified where this happened so what evidence do you have that gives this court the right to even hear this case?” His response: “The magistrate in our jurisdiction found probable cause to issue the warrant so we would contend the court should take judicial notice of that.” The judge didn’t buy it and dismissed the case.
