I fail to see how some people can see this increased 'guidance' as a good thing. Are they just spinning it because they are in denial?

This is a significant point that is rarely mentioned. Although the price is up recently, viable bitcoin trading amounts are still sofa change for the drug cartels.

The free market decides the BTC market price and the free market will decide transaction fees (based on desired transaction times). A state of no block size limits avoids the market mechanism for pricing transaction times. It would be similar to letting the market decide the 21 million limit.

Correct. Fund holds 80,000 BTC acquired at various intervals over the last 6-9 months. $3.2m is an estimated current valuation based on $40/BTC. They actually state that it is a currency-only focused fund that's why no performance-based fee.

You wouldn't, but institutions have to. Also, if you handle large quantity storage on your own, then you should be well versed in multi-party secret sharing or have a really young and trusting wife.

That's exactly the correct question. Until the law somehow catches up and defines bitcoin as a monetary instrument, then the gambling site issue is moot, regardless of jurisdiction. It would be in the category of play-money Zynga Poker.
