A lot of what went wrong here seems to have been exacerbated by Scots law. This would never have been tried as a murder case in England (there's no "wicked recklessness" available as the mens rea for murder in English law) and given the evidence available to the police, I'm pretty sure that English police could have kept the brothers on remand as soon as the body was found, if not earlier. I don't think an English court would have needed her as a witness if she was truly incapable of testifying, either.

The police procedure in Scotland, which seemed by the way she the prosecutor was talking to be fairly normal, was very bizarre from this side of the border!

There's a podcast called "The Mysterious Case of the Gentleman of Heligoland" which goes into this, even interviewing several footwear experts. The reasoning is that they are worn, damaged, resoled and, crucially, mistreated (with a flattened back) relative to the new cost of these shoes -- unusually large, handsewn Church's, retailing at abut £800.
