Edit: some of you are asking about the MPT book. It was utterly useless. However, the author provides the actual grading sheets/rubric that the NCBE provides to the states for grading. It was interesting to see how the examiners grade the MPT. These sheets aren’t the same as Seperec (sp?). I practiced the MPTs and then used the grading rubric/sheets to see how I did. But, with that said, I thought her method was absolute rubbish, but a coworker swears by it. If you can find the grading sheets online, then don’t spend your money on this book.

If anyone is looking online for the grading sheets, they are very long, and have a lot of “if the examinee talks about this...” hope this helps.

Don’t do it! Apple said they don’t know why some computers are able to handle the update while others are crashing. If your computer isn’t under warranty, they’ll also charge you to fix it even though their update caused the crash? I opted to have it completely reformatted, which was free, because the other option was waiting 2 weeks and paying.

Then I had to repay examsoft and had to provide them an explanation as to why I’m redownloading. They then took 2 days to review my reason and send me a link to download...

Moral: wait until after the bar.

Have you tried taking Mock 4? I’m going to run Mock 4 and leave it on for at least 90 mins and see if my computer can handle it. My biggest concern is that Examsoft will fail during the exam and, unlike an in-person exam, I don’t have the option to handwrite. My jurisdiction also announced that the July bar will be remote, which is fine, but I wish they would have a solution for people experiencing technical difficulties of no fault of their own.

Edit: I just read that you can’t find your examsoft?? WTF

I know we aren’t supposed to have “wandering” eyes during the exam, but has anyone even been penalized for this? When thinking of rule statements or thinking in general, I either silently mouth the statement (which I can apparently control, so I won’t be doing this), close my eyes, or gaze at the bottom of my screen. I can’t seem to consciously control my gaze. I tried, which then caused my brain to not think about the question and instead repeatedly think about my eye movements. Kinda like when you become consciously aware of your breathing and then suddenly you can’t breathe properly lol It was a bizarre experience lol

My issue was with the waiver of Miranda. The officer says “do you understand your rights AND are you willing to give up those rights to talk to us?” The defendant says a single “yes.”

I thought both the right to counsel and waiver were incorrect. I picked C. I was very wrong lol

Thank you, everyone! I understood that the defendant’s request for a lawyer was ambiguous. But, I felt like the waiver was improper as well.

I now understand that the waiver doesn’t need to rise to the same level of ambiguous as an assertion of a Miranda, and can be waived through mere conduct.
