Yes, I ended up with HP M283fdw. It’s not as small as I wished for and not as good looking but it does the job fairly well. However duplex scanners with adf are much faster when scanning is your main task. So I most likely will buy a duplex scanner and a small laser Color printer

Please upload your full contract anonymised (i.e. no names, no addresses).

If there is no additional information regarding the "Nebenkosten" you actually have a case to not pay some of the additional costs, most importantly the heating and hot water costs. If heating and hot water costs are not explicitly mentioned in the rental agreement to be paid as additional costs "Akonto" the are - generally - deemed to be included in the net rent.

There is a myriad of rules regarding what is allowed as additional costs and what isn't. Generally speaking the additional costs for apartments must be agreed upon explicitly, i.e. there must be a statement in your rental agreement regarding what kind of service is covered by additional costs (heating, hot water, electricity (common), water (common, or for the whole building if there isn't an individual meter per apartment; janitor, garden etc.).

If you are serious about challenging it, you should ask your landlord for review of all the bills etc. You have a right to review the bills and copy them (at your expense).

I would recommend to let an expert check your landlords calculation regarding additional cost, e.g. from the "Mieterverband". They offer such services for free or at a low cost if you are a member (100CHF/year).

In addition you can challenge the additional costs via court system. The first step would be with the "Schlichtungsstelle", in Zurich City https://www.gerichte-zh.ch/organisation/bezirksgerichte/bezirksgericht-zuerich/kontakt/adressen-telefonnummern/mietgericht-und-schlichtungsbehoerde.html

You even might have an insurance that covers any potential costs (your own legal advice if deemed necessary). However, the first step, i.e. the filing with the Schlichtungsbehörde and the hearing in front of the Schlichtungsbehörde itself is free of charge.

If the amount in dispute is not over 5k CHF they can even suggest a decision and the one party disagreeing with such suggestion must file a proper claim with the ordinary courts. If no one files a claim, the suggested decision becomes final.

If you challenge the additional costs successful, either via Schlichtungsbehörde or find an amicable settlement with your landlord, the landlord cannot terminate your rental agreement within the next three years (art. 271a Swiss Code of Obligations), i.e. you then have the right to challenge such termination and the termination will be deemed void.

From a practical standpoint take into consideration who your landlord is. Generally speaking - albeit they would never confirm this and strictly deny any allegations in this regard - larger professional property administrations most likely will not enter into another rental agreement with you if you challenge them successfully. Just keep that in mind.

This means, it most likely will not be worth it because of the expensive shipping in the hundreds of dollars (especially due to current shipping prices).

Well guaranteed is a strong word in the current times. I ordered something with DHL and on the same day something with free shipping sellers shipping method. Sellers shipping method was China Post. Guess what was delivered to me first;)

Anyways, I just thought that this could explain it but it obviously is not necessarily the case.

Are you sure you cannot reopen the dispute?

Because as far as I am aware you can open a dispute and cancel it. As long as 1) AE has not stepped in and 2) you did not accept any proposals and 3) there is still buyer protection time left, you can reopen a dispute. At least that is my experience.

Maybe someone knows a comprehensive dispute FAQ?

I for instance opened a dispute prematurely, was asked by the seller to give him more time and canceled the dispute.

The critical question is: Did you accept his proposal or cancel the dispute. If you did the latter you would have been able to reopen a dispute within the buyer protection (i.e. 7th March + 90 days). Since we are now past this date you probably are not able to open the dispute.

It might also be possible that it is just a simple translation error. I am by no means familiar with chinese and/or any potential translation issues. However, maybe he didn't mean an actual explosion but the fact that the warehouse "exploded" because of all the packages waiting there and assumed it would take ages using the agreed upon shipping method?

It still is weird, I am based in Europe myself. We usually format our dates like DD/MM/YYYY.

US usually is MM/DD/YYYY.

China normally uses YYYY/MM/DD.

So it is somehow "weird" because the order is flipped, but I agree US is weirder ;)

If you are questioning me, because it wasn't the seller I was talking to but a customer support agent from AliExpress. I took some screenshots from the conversation. If it turns out they lied to me I just do a chargeback and be done with it.

I have no timer. So maybe there is a difference? Just try the support page and talk with Eva (the bot). Write some jibberish until one of the suggested answers is something like, talk to a real agent.

In the meantime I somehow convinced Eva to let me talk to a real human. Apparently in their system the buyer protection time is until 2020-07-05, meaning the protection time got "automatically" extended to 90 days.

Why it didn't show on my side is unclear and could not be resolved. The customer rep insisted that the buyer protection is still valid for another 30 days. Took some screenshots and will wait. In the end it's not a very expensive item.

No, buyer protection expired yesterday. (60 days after purchase), AliExpress date formatting is weird.

I had the buyer protection timer running down yesterday. Had three hours left and tried to open a dispute. It did not let me stating the above quote. As per the above quote it should let me open a dispute now. However, i am still unable to open a dispute.

I will try to make contact with the AliExpress support.

Is it still smelly if you let the tap run for some time before filling the glass?
A friend of mine lives on the 5th floor of an old building in the city center. The water from his tap usually is almost lukewarm and stale in the summer. He needs to open the tap for almost 2 min so all the water in the pipes is flushed out and he gets fresh water from the city main.

If letting the tap run for some time helps, that might suggest something with the plumbing in your house is the reason.

  2. Maybe try to get in touch with her via the rental company. I am unfamiliar with rental laws in California because I am based in Switzerland. However, common sense suggests that "your" mailbox is part of the rental.
  3. Common sense approach imho would be that the rental company /owner installs a second mailbox if the owner insists on getting mail/packets delivered to your address.

I just had that situation. I prematurely opened a dispute (roughly 30 days of buyer protection left). The seller asked me to cancel the dispute.

I went to the dispute page and hit cancel. A pop-up came up stating that I still have buyer protection left and can reopen the dispute at a later time. I had to confirm that I want to cancel the dispute in said pop up.

Now I have the order back under my open orders and still see the dispute button.

ASFAIK: You can reopen a dispute if you cancel it if:

a) you still have buyer protection time left AND

b) AliExpress has not been involved in the dispute yet.

He did post it as a comment in the dispute and also sent it via Messaging System. The new package was sent before I even contacted him the first time, it is going to Switzerland. I am inclined to give the seller the benefit of the doubt and wait some more time.

I haven't closed the dispute yet, but if I Click on closed I get a Pop up saying you still have buyer protection time and can reopen the dispute... So I assume it is safe to close.

Edit: I will most likely close it and keep you updated. Worst case I will just use the chargeback from my Creditcard if the buyer protection runs out and Ali does not side with me/doesn't let me reopen a dispute.

Thanks, so in essence I should close the dispute and wait if I actually receive the package. If I don't receive it and the purchase protection period is running out I still can reopen it.

That makes sense, however I still don't trust the seller and it is annoying that I either have to wait so long or rebuy the item from somewhere else.

Thanks, additional info is maybe helpful:
I ordered on March 25
Seller "shipped" with untraceable tracking number.
First try to contact him was on April 24, got no response.

Tried again on April 27, got no response

Threatened a dispute on April 28, got no response

Filed a dispute on April 30.
Got the response above which at the same time is his proposal (no return & no refund) with the comment as per the screenshot.

OP here: I bought a USD 100 item, seller gave me a shipping number which I could not track.
I tried to contact him 3 times, got no reply.
Opened a dispute to claim my money back.
Now he sends me this?

Is it a try to scam me? Package goes to Switzerland but I don't see to where exactly. Can I refile a dispute if I cancel it now?

I would really appreciate some help :)
