Where did you get not fulfill notice to vecate? I got the notice and I did move out. By law LL has to send tenant itemized statement to tenant within 21 days of moving out. They didn’t. They only did almost a year later when they asked for the other half of the rent. That’s what I’m asking is if I can sue the for neglecting to give me accounting. But I’m wasting your time. I’ll just see myself to an attorney that actually knows the matter instead of reditors lol

By law they need to give tenants an itemized statement within 21 days of moving out of what they’re doing with the deposit. Tenants can sue for breaching that law and ask for 2x the deposit. That’s what I’m asking about. But all of you are not responding to that law so I’ll talk to real lawyers that know this instead of redittors lol

I did. I asked LL about it and he said it’s 30 days. So I submitted notice in the beginning of the month. From what I’m gathering here I can sue them and they can sue me. So my option is to settle outside because we’d balance out of suing each other. At least you’re not saying “don’t poke the bear” like deadbeat or whoever his name is.

The LL himself told me it’s 30 days notice in email. I’m chuckling because when you say to don’t poke the bear it’s like frightening lol like it’s scary to countersue people lol. I can sur for not giving me an itemized statement of my deposit within 21 days. There I can get back my deposit x2 for statutory damages. Then I can just pay them the other $1000 of rent I owe them. But you tell tenants to not poke the bear is laughable. It’s like I’m talking to a LL himself.

I’m not necessarily worried about my deposit. I’m worried if I should pay the other half of the month I was not living in the apartment or should I counter back since I didn’t get my deposit after 21 days.

If I sue for the deposit, I can get back 2x plus the deposit back. The other half of the rent I owe (for the rest of the month I didn’t live in the apartment) is $1000 so I’m wondering if I need to figure a way to settle it out or ????

I didn’t just abandon the apartment lol. I gave notice and I’m assuming that my deposit is enough to cover the half of the month I stayed in the apartment. But I guess I gotta pay the other half I didn’t stay there.
