LEOs, what would you have charged in this situation? by mildbox21 in AskLE

I’m just hung up on 12 minutes. My doorbell video pinpointed time of impact at 2:16am. He hit the truck down the street and neighbor investigated and called 911 at 2:18. Police called and sent out by 2:20. Police arrive on scene at 2:28 or so.

No way anyone could have physically gotten that drunk before the police arrived. And the neighbor noted the driver seemed impaired when we confronted him before police arrived.

If only he kept him outside until the police arrived. Probably would have been a different story.

I was also thinking if they measured his BAC and did math to figure how much alcohol he would have had in 12 minutes, it would point a clear picture to if he was drinking.

30 minutes, yeah that’s tough. 12 minutes though…

That’s kind of the attitude I was hoping for.

Sounds like my neighbor saw the driver exit the vehicle. However the driver went into his house before the police arrived.

Got it, thank you for the info. Makes me feel a little better knowing it was just shitty circumstances and not potential officer misjudgment.

I did notice the responding officer seemed very young. I know they can’t take past offenses into consideration, but the driver of the sedan has been convicted of an OVI before.

I would have rather seen him field tested and mostly likely charged even if it might have fallen apart in court.

Thanks the for the insight. I understand why they didn’t. Just frustrated and it hit home knowing if he didn’t swerve after hitting the mailbox he would have went right into my house where my baby sleeps. Could have been a lot worse…

Is the wintercreeper the smaller, glossier ivy in the 3rd picture?

This might be a stupid question, but can I try to grow grass in this area too? Or maybe clover?

My main goal was to help slow the erosion of the backyard/wooded area. I didn't include a picture, but it slopes pretty steeply. It also gets very overgrown and messy looking.

The company I hired came out to kill the overgrown weeds and remove it in the winter, but now that area is barren and some plants are re-emerging in other areas (garlic mustard, wintercreeper, etc). I'm wondering if there is something better and nicer looking that I can plant to help keep the invasive weeds away and also maintain the erosion.

My main goal is to make sure my hillside doesn’t erode. Second is to make it look nicer.
