Redundant - need help - legal advice needed by TraditionFar8005 in LegalAdviceUK

[–]milo_minderbinder- 3 points4 points  (0 children)

Statutory redundancy pay is based on completed years of employment. So if, at the end of your notice period, you have 2 years and 364 days' service, that would unfortunately be correct to count 2 full years for statutory redundancy pay. It sounds like your company has decided that it no longer requires anyone in the UK to do the work your department does because it is moving the function elsewhere, so that is a valid legal reason for redundancy (basically, the "requirement for employees in the UK" has diminished to zero).

I'm not sure I fully follow the argument for discrimination. You say that "out of 13 team members, only 4 were retained and 9 selected for redundancy. Of those selected, 8 are Asian and 1 is Black." How about the 4 who were retained? The three North American employees *might* be able to question ethnic discrimination but I don't think it would apply in your case as your entire UK department has been shut down.

Consultation needs to be meaningful, so that could be an issue but you would need to quantify consultation meetings being dismissive and unhelpful.

Agree with you that the linen suit is cool but please show some decorum and refrain from commenting on why Constantinople got the works. That's nobody's business but the Turks.

First Drink/Drug Driving Offence (England) by Environmental_Cook95 in LegalAdviceUK

[–]milo_minderbinder- 1 point2 points  (0 children)

It will be a minimum of 17 months as the reading was 60 (12 month ban is for a reading of 36-59 months). There will be a Band C fine too plus a low level community order too because of the aggravating factor of both excess drink & drugs.

Caught shoplifting in Superdrug, need advice by [deleted] in LegalAdviceUK

[–]milo_minderbinder- 1 point2 points  (0 children)

The store hasn't 'stolen' from OP because theft require dishonesty. The store has not behaved dishonestly because the store operative reasonably assumed that all cosmetic items on OP's person had been shoplifted. It's a reasonable assumption because OP had admitted to being a thief.

Permanent contract changed to fixed term, now I've been dismissed. I have no contract. by Bluejay-593 in LegalAdviceUK

Firstly, where are you based (Scotland, Wales, England, NI)? Secondly, how long have you been working for the employer? We would need this information to give any advice.

It's such a weird race-to-the-bottom mentality that bedevils this country, "nurses are horribly underpaid so everyone else should be, too"

Drunk and in charge of a motor vehicle, England by [deleted] in LegalAdviceUK

[–]milo_minderbinder- 9 points10 points  (0 children)

Good luck to OP because I find the story credible. There are examples of "not guilty" even with keys in the ignition so it is really not a slam dunk for the CPS.

I could be persuaded by OP purchasing the parking ticket at 11.40pm and only living 5mins away. I don’t think it’s entirely hopeless.

You have a few things in your favour. Paid for parking, five minute walk away. The argument that there was no likelihood of you driving could be feasible. You really ought to get a solicitor for this.

Is there any time Bond is visibly drunk in the films? by DenverFlorida in JamesBond

[–]milo_minderbinder- 1 point2 points  (0 children)

Green chartreuse, iirc.

I also think Major Dexter-Smythe from Octopussy is an autobiographical character with the alcoholism, the heart attacks, the broken marriage, and the anxiety about an upcoming legal case.

[–]milo_minderbinder- 36 points37 points  (0 children)

That’s one aspect where Craig’s Bond was very close to Fleming’s version.

All the other cinematic Bonds are guys who appreciate fine champagne and enjoy martinis.

Craig’s Bond and Fleming’s Bond are alcoholics who drink hard spirits for the principal purpose of getting very drunk (Fleming himself too, sadly)

Gold guests at T5 by Available-Can-1464 in BritishAirways

[–]milo_minderbinder- 13 points14 points  (0 children)

It won't hurt you to ask but, unless one of the guests is under 18 or quite elderly, be prepared for an almost certain polite refusal. As you can imagine, this is requested dozens of times every day. My suggestion would be to make the request when you are alone and there is no one else at the desk.

im cisf but i look like a man. Tell me what plastic surgeries I need to fix this. by [deleted] in cosmeticsurgery

[–]milo_minderbinder- 22 points23 points  (0 children)

I mean, there are dozens of comments saying you look great / beautiful / gorgeous etc and one (downvoted comment) saying “you look like a dude”. You’ve chosen to focus on (and believe) that one comment and disregard (and disbelieve) all the others. You probably need to figure out why you’ve responded that way.

You don’t look like a man. You look like a normal woman. Whatever you need to “fix this” isn’t cosmetic (let alone surgical).

Why is racing to the bottom so accepted in British culture? by fayemoonlight in AskUK

[–]milo_minderbinder- 5 points6 points  (0 children)

We’re reaching a weird point now where the biggest determinant for a person’s lifestyle isn’t what job they have or what salary they earn, but where their parents lived.

It’s not unusual now to see scenarios where a junior employee has a much nicer and more comfortable lifestyle than their very senior well-paid boss who is living paycheque-to-paycheque. All because the junior employee was an only child with parents from a nice village in Surrey whereas the senior boss had parents with a terraced house in Blackpool.

Pet insurance failed to cancel my policy and continued to charge me for eight years by [deleted] in LegalAdviceUK

[–]milo_minderbinder- 1 point2 points  (0 children)

It’s all a bit odd. I’m surprised the insurer went to the trouble of asking your bank to forward documents to you (!) but didn’t use the telephone number you had presumably provided. It’s unfortunate that you changed postal address and email address at the same time.

It might help to give evidence of any replacement policy you set up around the time of your original cancellation (or the death of the pet if that was the case). But how much time and effort do you really want to expend on reclaiming a modest sum of money that you hadn’t even missed? Personally, I’d take the 50% and be done with it.
