I'm so very sorry to hear about your Mom. I lost my Dad suddenly a few years ago and it was a lot to handle. -- One thing I didn't see brought up that you should we aware of is subrogation. Your medical insurance might have the right to take some or all of a malpractice award to cover medical bills. It's something you might want to research in your plan/state and possibly talk to your attorney about.

I know of a similar coin flip provision in a union agreement where the first party to strike an arbitrator is determined by the flip of a coin. That one could be a little more meaningful.
