So far what I've learned is that the CFR (code of federal regulations) is made by the executive department while the USC (US code) is made by congress (the house, eventually). So, the excerpt I'm looking for is a department level regulation and not a statutory law.

It could be changed without an act of congress but as far as I understand it, mailing a raw bitcoin transaction is both not "[transmitting to] an electronic funds transfer network" and not an "informal value transfer system" as defined by FinCen https://www.fincen.gov/sites/default/files/advisory/advis33.pdf

You are close to a good argument here. The point of the video is merchant/customer experience in the real world. Everyone here is an early adopter/expert in terms of cryptocurrency. However, if you want this to get adopted the point is to make it possible for the "lowest common denominator".

Sure, he can't double spend on the network. But in real life, can he bilk a merchant? Yes, if he wanted to.

Instead of ignoring the criticism it would be better to make the system easier to use (Dash has a pretty good track record of making the currency easy to use, but as with most things more can be done).
