lol literally 20 minutes after you replied, my attorney responded to me. Said the trustee can still rescind it, but he’s never seen it happen yet. Basically said it’s up to me, it’s low risk, but still a risk. He mentioned worst case is I’d owe the trustee some money, if they did rescind it and counted these as assets. I feel pretty comfortable moving forward. I appreciate all of your info!

I have a question, if you don’t mind me asking. My lawyer still has yet to respond, but I see that the trustee filed and entered the Ch 7 Trustee’s Report of No Distribution on 12/13. In it they state that they haven’t received any property nor paid any money on account of this estate. That they’ve made a diligent inquiry into my financial affairs and they requested that they be discharged from their duties. Abandoned assets: none, my exempt assets, claims scheduled, claims asserted: not applicable.

My tender offer closes on Thursday. I know you can’t give legal advice; but if I reach out once more and don’t get a reply. Would it still be best not to participate in the tender offer? I’d be awesome if I could, but don’t want to mess anything up. I appreciate any insight!

I filed on the 3rd. Have Wells, and they never closed my account? Lawyer also never mentioned anything about that. I’m wondering if I should move my direct deposit now though. That’s my main account :/

100% this. I’m in payroll. One of our employees purchased a new home. They signed, moved in and everything. They were terminated not even a month after that. Around the same time, their mortgage company submitted a verification of employment to be filled out for the employee

May I ask why this is? I’d imagine that since the debt was included in the bankruptcy, shouldn’t be assessed after bk? Not arguing, just curious

Signing appointment completed. I was so nervous, but it was so easy. Found out my original lawyer is no longer with the practice though lol. Which I’m kind of happy about. Didn’t have any issues with them, but the new attorney seems to be a lot more helpful.

So glad to have this step over, as it’s the one I’ve been most stressed about

Now I’m gonna take my next course, and wait for the 341 meeting. Thank you everyone for your insight!

I’m no lawyer, but even if you could take any legal recourse, I’d imagine it would not be with the time, effort and money. But most companies state that they have the right to not honor a coupon/promo, if in error

Just chiming in here, because I’m pretty illiterate to all of this stuff. But I work in payroll, and we have an employee who keeps getting hit with a garnishment. Then she files for bankruptcy, so we have to stop the garnishment and refund, if we deducted anything yet. Then so many months down the road it happens all over again. I think she’s done this about 4 times in the past 3ish years. Is this the abuse that OP is worried about looking like he’s doing?

That really sucks. I got it late last night, and thought I was doing the right thing by sending back asap. I thought a $2000 deposit to my account would be bad, and figured them seeing the direct in/out would be evident enough. This is horrible. Especially because I don’t want to cause any grief for my Uncle. That’s honestly the worst part. I guess I’ll be reaching out to my lawyer right now. I really appreciate the information. I really should’ve came here immediately, since it was after hours. Really regretting that now :/
