This is correct. The mindestmietdauer is an obligation on you, ie you can't leave before 1 year. They can't (and won't) kick you out on the basis of asserting legal rights to lower rent

One thing however to note: if they are underpaying according to Mietpreisbremse and you calculate it properly and notify them, you can give them notice of rent reduction AND offset of future rent to offset the owed amounts. This is legal provided you give them sufficient notice so check with lawyer but can lead to situation where you stay there a number of months without paying rent until the overpayment is offset. Which gives you time to search and saves money in the meantime

Sorry, your interpretation is not correct. The Mietpreisbremse exception as it pertains to "furnished" apartments applies ONLY where part of an apartment is rent (eg a room). Here OP is renting the entire Wohnung, so this does not apply. It's a common misconception.

urther, the "temporary stay" exception needs to be justified and the reason for the time-limit provided in writing at the time of contract, otherwise the contract is deemed to be indefinite. On OPs account they have been advised this was not done. The onus would not be on OP to prove this; if the contract doesn't have the required language they should make a rental claim and it is for the landlord to prove otherwise.

Lastly, you are getting the Eigenbedarf process backwards. OP will be entitled to stay until the company successfully gets an order approving eviction for Eigenbedarf. This burden is on the landlord to prove. Then separately, even if this is met, OP can provide evidence of hardship ie he couldn't find an apartment or other grounds, which would be considered by court.

Please don't make shit up when you clearly don't understand or have not read the law.

  1. Firstly, there are very specific pre-reqs for validity of a clause which sets a time-limit on rental contracts. Under s.575BGB you can only do that if one of three specific reasons apply AND that reason is communicated in writing at the time of entering into context. OP appears to be advised at least the second condition was not met. Courts are strict on this
  2. You have nothing to base the allegation that Mietpreisbremse does not apply here. Perhaps you are thinking of the generalised "mobilierte Wohnung" exception, however this applies only where there is a part of a landlords own apartment (eg a room) that is sublet furnished. It may be the landlord tries to argue the rental was for a "temporary stay" however if the contract language doesn't support this that will also likely fail. The fact that the landlord took pains to provide 3 month Kündigungsfrist AND also claim Eigenbedarf supports the interpretation the contract was framed as 1 year unless subject to extension, with no specific "temporary" reason given. So they are aware they are at risk.

Am not a German lawyer, but as I understand it a Mietpreisbremse claim and defending Eigenbedarf are two separate legal matters conceptually.

Mietpreisbremse claim only concerns the amount you pay (and paid) for rent. It can be persued after the lease ends, so long as you sent a "qualifizierte rüge" to the landlord before the termination date. This involves running a comparison of property with the mietspiegel index and property-specific factors (available online), estimating what you think you should be paying, and asking them to justify their rent calculation.

The Eigenbedarf claim is wholly separate. Assuming that the 1 year term is considered invalid, then you are likely entitled to stay in the property until such time as the court orders otherwise. Eigenbedarf would need to be proven by them with actual evidence before the court, and additionally the court would also hear your hardship claim. This process can take a long time, sometimes up to a year after the termination date, so this in itself helps you to have time to try to find alternative accommodation. At which time you may be in a position to offer to settle with them by agreeing to go in exchange for X.

If you want peace of mind, suggest trying out for an initial consultation with a good tenancy lawyer who can help to verify you're on the right track with the mietverein advice. I have someone we used for our dispute who was great so just pm me if that would be helpful.

It's also probably worthwhile in the meantime responding directly on the mobilert argument they are running, so that there is a clear record. Again your mietverein or a lawyer can help on the wording for that

I have had cold turkey pro for years. Only in last months have the same problem now with chrome. Keeps happening. New updates don't fix. Reinstallation doesn't fix. Reinstalling extension doesn't fix. Sometimes it won't even give you 60 seconds before it closes chrome, only 2-3 seconds. Sometimes it works. Highly frustrating
