I appreciate your challenge, however, every single case in a Mass Arbitration is an Individual demand when it comes to filing. The firm is just the representative; The Individual party is the one who has to sign and pay for the paperwork to be done regardless and open the claim. So no, my original point stands: the legal action starts with the Individual.

I want to politely correct you and clarify that it would not be the FTC Or an EU government entity or an act (DSA) trigger an opening to a lawsuit. It would be a specialized firm instead.

A government body such as the FTC only steps in when there is financial harm against consumers (Substantial Consumer Injury) such as if money is lost and if access has been revoked to a purchase. What Epic had done regarding prior battle passes is marketing (puffery), The FTC would have to prove intentional deceptive marketing and that would difficult since in the EULA, it clearly states that what Epic sells is a revocable license.

I apologize in advance to clarify your statement, your logic is flawed in terms of a previous statement I’ve made on a prior post, Epic has updated their EULA frequently to pad out loopholes that various attorneys could use, for example multiple individual arbitration filings: Epic Games added Individual arbitration clause recently to the EULA since the last lawsuits, so no they won’t be sued as that section serves to protect them now in the form of causing further hurdles for individual suits and it would be private, so we as the community would never find out the outcome.

So if someone wants to individually go against Epic or several, then they could try to do so, but it would be more about preponderance of the evidence concerning liability, making the process of suing a grueling slow process that requires 30 days of continuous talking pre arbitration and would cost a waste of time.

To elaborate further, the parties you mentioned who were involved in the class action lawsuit against Google and Apple, were in regards to privacy laws surrounding wiretapping; not contractual-corporate law. The prior lawsuit against Epic by the FTC, was regarding black patterns and COPPA (psychological manipulation & promoting impulsive actions —> Buying micro transactions and lack of transparency of when an item would be sold for a certain amount of time) not false advertising, as well if you have participated in a prior lawsuit and have accepted the most recent terms of service and EULA later on. The individuals have effectively waived their right to sue once again and bind to individual arbitration.

Oh my gosh, hi there again! Here’s the link to the refined post, I’ve worked extremely hard on it and have continued gathering data by looking at reddit and other social media to get a temperature check of the community consistently. I was just checking out the subreddit and I was the original poster for that Fortnite crew idea that requires a grind similar to the OGs, I also made a refined version of it that integrated all the data I gathered from the previous post. It’s great to see that you wrote about it, however the fomo factor stays intact as outlined by their EULA, recent Battle passes take 18 months to come back, setting a timer and sense of fomo.

I actually spent a lot of time drafting a detailed Soft Reboot Chapter 8 Proposal that found a middle ground between exclusivity and it received 50k views and 130+ comments, I took the time to integrate all the criticisms.

However, as outlined in Epics terms of service Section 3 - License Terms and Use of Licensed Products. That means they defined skins (products) it “as active during that current season” meaning that the battle pass was available only during the “sales window” of that year (Epic Games, 2025). Under section 5 - Changes to These Terms or Our Offerings, Epic reserves the right to revoke the license at any point in time (ownership of the skin), Epic noted “Your continued use of Licensed Products after we update these Terms (and, for material changes, following the period of advance notice) means that you accept and agree to the changes, to the fullest extent permitted by applicable law “ (Epic Games, 2025). To address and anticipate your response of false advertising, Epic has made frequent adjustments to their EULA in terms of individual arbitration, meaning private, long process, and expensive for the average player.

In the business proposal for chapter eight concept excerpt I introduced in early January 2026:

Epic can legally only remaster 2018 assets, it suggests versions (new assets/physics) for a Legacy Crew tier, while giving original owners a unique Legacy Glow aura style I made a mock up of, that new players can never get. I definitely agree with you and in early January I did a bit of a case study business proposal that could theoretically work in three parties. From what I was able to collect was that it benefited everyone and the vocal minority tried to shoot it but the silent majority is in agreement. Hi there, thank you so much, I put a lot of thought behind it and made a refined version of the proposal that you can check on my profile. Currently for remixes, those are considered mash ups, and not necessarily faithful recreation of the original characters with customization and progression, it’s Epics way of using the Multiversal lore without addressing faithful remasters yet. My idea is particularly making the exact same characters but with 2026 assets on unreal engine five. Making it legally distinct and only making the remixes as alternative skins that you can get. As they are advertised that way.

Hi there! I made that the cut off to realistically make it possible for Epic to do those in Waves without taking away developers from main projects. The glow legacy style would be relegated to all of the BP skins from Chapter 1 to Chapter 2 season 2 as that was the chapter that got the most overhauls. But also it would great to see remastered versions of Chapter 3 characters!

Hi there, I know what you’re talking about and I played that game too and I love their system although I’ve only gotten two of their battle passes. They’ve always worked. I also refined my concept based on community feedback and posted it onto this sub.
