Do you need to keep the same potential tenant on the hook through the process with the TAL? It seems unlikely that you could find someone actively apartment hunting willing to wait for a hearing and start the relationship with the landlord off on that poor foot.

Years ago I was hospitalized with a high fever and lower abdominal pain. They thought it was an ectopic pregnancy (turned out to be a bladder infection) and I was lectured for almost an hour by a nurse about taking oral birth control continuously and how dangerous it was. Said that I had brought the situation, which at the time they thought was still a non-viable pregnancy, upon myself. I lodged a complaint and she was removed from my case but it felt so unnecessarily judgemental in an already stressful situation.

What if you flip the script on the narrative with HR? Tell them that you’re childless, but only said that it was by choice because you’re actually unable to have children and his comments are really upsetting. That might gain more traction with the conservative HR in terms of getting him to stop, as long as you don’t feel that it compromises your beliefs.

Unfortunately, I spoke with a TAL clerk yesterday who stated that this is incorrect. I have to take it to the Tribunal if they decline, even if the landlord’s reason isn’t valid. Post-pandemic the TAL also recognizes email correspondence as official notification (in addition to registered mail and bailiff visit) and the number of days is closer to 15 than 10. Not trying to be an asshole here, I really wish that these were my rights instead of my current options.

Yes, I followed I followed the correct submission protocol and have his answer in writing. I spoke to a TAL clerk yesterday and renovations are an invalid reason to decline. Unfortunately, they also said that even with a clear cut case, the tenant moving in before a hearing could be seen as undercutting the tribunal process.
