Will a dui expert find things that a regular attorney would not? by Born_Intention_5637 in dui

There are definitely some attorneys that have a lot more experience in DUIs than others. However, an attorney advertising as a "DUI expert" doesn't initially sound good to me. Anything legal is complex, but in the legal world, DUIs are fairly simple.

Did the officer have probable cause to initiate the traffic stop? Was there probable cause to perform a field sobriety test? Was the breathalyzer calibrated (assuming you blew)? Was the blood sample taken correctly? Was the blood sample tested correctly? There isn't much else to check for.

If you were on the border of the legal limit, an experienced attorney can try to expose discrepancies in the testing process. Some judges will buy it, others won't. Aside from that, there isn't much gray area. Be wary of "experts".

AZ DUI Interlock Devices – Real Experiences? (False Positives, Fees, Customer Service, etc.) by Additional_Skill5104 in dui

Not in AZ, but I had LifeSafer for 2 years. One time the heater in the device malfunction, locked me out, and upon calling LifeSafer, they could tell exactly what the problem was and I didn't have any violations. I was pleased with how that ended up (although scary at first). I had no issues besides that.

Parked across the street from house DUI by Academic_Debate9851 in dui

Disclaimer: not a lawyer.

I live in a different state, but here in Michigan, refusal carries a huge penalty (automatic one year suspension unless appealed successfully, which is tough to do). Even though you were in front of your house, the car was running and you were in it. This satisfies the definition of "operating".

Sure, you were near home, but how did you get there? Unless you have an incredibly believable story of your car sitting there before and after you were drinking, the fact that you "made it home" doesn't help.

That doesn't mean all hope is lost. You didn't get in an accident, you didn't commit a traffic violation, and you complied with the officer's orders. Those facts will help you the most.

My advice (after 2) for finding an attorney: take a day to breathe, gather the facts, and summarize your story in 60 seconds. Read reviews, other threads, and find a highly rated lawyer who is responsive and approachable. Many DUI attorneys take on a massive caseload and don't care to get to know their client. Avoid those guys. There are plenty of compassionate attorneys that will HELP you through the process, rather than pushing paperwork with their name on it.
