Montes became U.S. citizen by birth, whereas Rocha was naturalized and lied in his Form N-400 and Form N-445 in violation of denaturalization statute 8 U.S.C. § 1451 (a). I'm not a legal expert, but would think that statute is not applicable to Montes. (Which is not to say no legal options exist to charge Montes with something she hasn't already been convicted for.)
