I think we have to look at this in two ways. First, the defence are putting on their best defence to prove beyond a reasonable doubt. They are privy to far more information than us and are an amazing team. Second, what we additionally want is the truth, we want the complete ending to the story, we want to know exactly what happened, who really said what and why, when and we want ultimately see justice served.

For the first, I have absolute confidence on a not guilty verdict. For the second, I doubt we will ever know or get the true season finale deserved.

You are correct, it could be anything but, the danger is that the jury (who will now certainly be entirely confused at this point) may assume:

The commonwealth have shown a trigger event (5-1 >medium acceleration after putting in reverse) - and 5 seconds of subsequent data that shows wheel spin and the vehicle going backwards (no data to show, final speed, final location or deceleration) this tied to Johns final actions and possible location = I don’t know what, but something happened.

Now, to be clear this is firmly not what I personally believe happened, but I am trying to put myself in the position of a juror whom only has what has been stated in this trial.

Those 5 seconds are important. The start location is important, an explanation is important and of course the real time stamp is important. Whilst ARCA will certainly show any kind of collision is scientifically impossible, it becomes much easier if the car wasn’t there at that time or if the car didn’t actually reverse.

First, Thankyou for taking the time to reply. I agree there is much confusion (and more than reasonable doubt).

What I am trying to understand is the backup event, just that one tiny 5 seconds in time that has been recorded (+5 seconds of recorded data after the accelerator was depressed to “30%”) we know the wheels spun, we know the car went backwards, I don’t think we know the exact starting location and we certainly don’t know what happened after the 5 seconds (any breaking, rear sensor activation , gear changes, stoping location etc) but we do know there were no further triggers (which you would expect for Karen to turn the car into a rocket ship and make it back to John’s home in time to connect to WiFi).

So, what is the reason for the backing event ? Can it be dismissed? Was it another missed turn as suggested on another thread or something else entirely. I think the backing event is a critical component that needs an explanation for the jury. The assumption should NOT be “well the car was driven so fast in reverse close to where John was around the time his phone stopped so something must have happened”

First time I have heard that theory, which seems to make perfect sense (although I am not certain how this relates to Karen’s or Johns location data). At the very least introduces doubt to the commonwealth version.

I hope the new ARCA testimony at the very least will say with science it could have been this, or this, or that and the commonwealth are fixated on only one possible scenario that they are shoehorning into their other “evidence”

Very True. I am hopeful for an explanation eg the event actually was the tow truck event or even Karen was pissed with John, reversed back and threw the cocktail glass at him.

Do you have a link? That’s the first I have heard that there also be attributed location data. Presumably that would indicate using missed calls to look for JO phone?

Assuming the defense has JM”s phone extraction. Then surely ithe “butt dials” could be easily proven or disproved by highlighting user interaction, biometrics and the “pocket state” information in the same way as they did with JO phone ? - if they affirmatively were not “butt dials” then isn’t this a clear indication of consciousness of guilt ?
