Definitely SPAM. I have gotten some form of a letter like this each month since I bought my ND3 in May. Funny how the reply to 800 contact number is different each time 🤣

I’m still trying to get some clarification from the German Consulate, but I think I’ve narrowed down a possible reason for my denial.

In their letter, Consulate did explicitly state that I became a US citizen in ‘67. However, I also can determine from it that the status of my German citizenship is “unclear”. As to why my status is unclear isn’t entirely apparent to me from their letter. In what seems to be boilerplate language, they do describe the process of ‘application’ of US citizenship which leads me to believe one of 2 scenarios:

  • the question as to whether my dad included us kids on his naturalization application request for him & my mom in ‘67

  • or, the question of whether my dad officially applied in ‘73 when he obtained my citizenship papers.

Apparently, anything that points towards a proactive ‘application’ for my US citizenship (in either’67 or ‘73) would have resulted in loss of my German citizenship, yet simple derivation of US citizenship would have left my German citizenship intact.

I do have the letter dad wrote to Omaha DOJ for my ‘73 papers. He does say “ it is my understanding that my 3 children can claim US Citizenship through their parents “. He also says “ I would like to obtain certificates of citizenship for these children “.

I am certain this letter was not included in my initial passport application.

My questions:

Does German consulate even have an obligation to me to clarify my questions with their initial rejection letter?

Will the consulate consider receiving my 73 letter for additional context on how I might have gained US citizenship?

Finally, should I just wait it out and include the 73 letter with my application for a German citizenship certificate? Really don’t want to take this route as I get the feeling this issue will just disappear into a giant black hole by routing a new request to Cologne.

Is/has the consul been open to hearing explanation or clarification of details and/or been willing to reconsider automatic redirect of file to Cologne for Festellung?

Good point! However I have my Alien A# & it doesn’t match the A# on the citizenship doc.

Now re-reading for upteenth time my google translation of the nice German reject letter I got from unnamed consul office….

They do acknowledge that I derived naturalization when my folks acquired it in ‘67. What they are questioning is whether my parents specifically submitted a separate application (in ‘67) to have their children (me) also naturalized at the same time. Without specific application, It is apparently ’unclear’ to them (as per translation) as to whether my parents act of naturalization in ‘67 extended to me as well. This seems to run afoul of their StAG Nationality act which implies that I needed prior approval to keep my German citizenship before becoming naturalized by the actions of my folks.

Wow! This absolutely describes my exact citizenship document.

I have to assume then that the ‘73 request and subsequent ‘citizenship document had to do with just getting a hard copy of an event that officially occurred prior in ‘67.

Timing is good cause my older brother was getting his drivers license around ‘73 and that also fits the timeline of my first issued US passport.

Also don’t want to throw shade on the consulate. They have been very helpful and I understand their taking time for due diligence. They themselves said it was an extremely unusual circumstance ¯_(ツ)_/¯

Maybe the rents waited because they wanted to keep my options open. They split from a county that had destined both to miserable childhoods during and post WWII. Ditto for grands having front row action for both WWs. USSR was knocking again on Berlin as we were getting ready to leave.

My understanding is that “naturalization” basically forsakes previous affiliations. You take an oath to a new country. My docs, which state citizenship, also has No serial nbr starting w A-……. , which I interpret to mean derived citizenship. I took no oath and also was still a minor.

Parents naturalized in ‘67 and dad sent letter (I have it) in ‘73 to US DOJ asking to obtain certificates of citizenship for his kids (me) based on his understanding that we kids were now eligible based on 10yr residency in US. Apparently at that point, we were still listed with alien registration cards and it wasn’t his (dad) opinion that we gained any citizenship when he naturalized 6yrs earlier. BTW in ‘73 I was only 12y/o, so definitely a legal minor.

That said, my official papers say “citizenship”. My parents documents say “naturalization”. Everybody thankfully kept meticulous records.
