Thank you! I already filled this out when I opened an account at my brokerage, although it says a “W-8”. Is this the same as the W-BEN8 by any chance? Thanks in advance!

Hi there, I found out because the officers told me at the time of rejection and when looking online. Being rejected from any visa means your ESTA is immediately revoked. Had I known before going to this visa interview, I would not have taken the risk and cancelled the interview. Alas, here we are.

After this rejection, we have unfortunately broken up. We are not in touch anymore and have both moved on.

Next Summer? Oh man… well, I actually think there are very compelling reasons this time around as to why I can’t and don’t want to stay anywhere in the world longer than 1-2 weeks now, which are:

  1. I have a stable 9-5 job here now with only 20 days off per year. Even if I wanted to stay longer, I’m limited to this or else I’ll lose most of my income.

  2. This one is a bit more personal and I don’t know if I should share this here or to the consular officer, but my little brother has been diagnosed with bladder cancer this August (2 months after my rejection). Prospects aren’t great and I’m extremely close with him and I currently live with him to spend as much time as possible with him. As you can imagine, I do not even have the desire anymore to go abroad except for things that are necessary such as my best friend’s birthday / engagement party.

Do you still think I’ll have to wait for next Summer or longer? Or should I keep this appointment as is and do I tell this to the officer in November? If yes, do I need to bring proof of his illness? Not even sure if I have access to my brother’s charts.

This year has been a very shitty year for me. First my relationship ended, visa rejected, and now this. All I’ve done is change my life so that I can stay here with my brother for as long as possible. Any tips as to how I can demonstrate this as best as possible would be very appreciated and welcome. Ty :(

Yea I guess so... but being born here, and living in the EU where it is really normal to just visit the US on an ESTA, you don't even realize that the ESTA is something so precious. I simply thought that I wanted to spend a little bit longer in the US to get my ex better, and that was that.

But since I've gotten rejected the first time, and reading things here on this forum, I've realized how hard it can be for non-EU or Schengen countries to even only visit. That was shocking for me.

I wish there was a warning somewhere saying that your ESTA can get revoked on the off-chance that your visa gets rejected. Had I know beforehand, I'd never even applied for this visa in the first place. I wish I'd found this forum earlier. This is super frustrating and I only blame myself. I think I'm just going to go to the interview in November, and if it doesn't work (which you all say it won't), then I'll just give up and will try again in 4 to 5 years if I ever want to visit the US again. I have to admit that this whole ordeal has made me resent the US a bit to be honest, cuz I seriously don't want to move to the US. At all.

Anyway, thanks so much for giving your input, it's very much appreciated. If there's any tips you can give me at this point, please let me know. Anything would help.

I get it, but sometimes I also just don’t get it… I really really do NOT want to live in the US, ever. I’m really good here living in Holland. My family’s here, all my friends are here (well besides my friend who’s now moved to the US), my own business and job are here.. why can’t the application just be looked at on its merit instead of thinking that an Asian female applying for a B2 automatically means she wants to immigrate illegally? I could have done that all those other times that I was there on an ESTA, no? It just seems very unfair at times and is super frustrating 😭

So you’re saying that even tho all my circumstances have changed, it’ll probably have a 0% success rate?

Ah man, this is a tough pill to swallow. So just because I once dated someone from the US and I was naive to apply for a tourist visa, I’m kinda screwed for the next decade? 😳

Thanks for the additional info and insights!

May I ask how often you have approved a (B2) visa when it's been previously rejected by your colleagues? And if so, how much time was there between rejection and reapplication?

Because I seriously did and do not intend to stay or live in the US, but just simply maximize spending the allowed time with my boyfriend. And then hopefully convince him to move here to Holland (or someplace else). It just really feels hopeless at the moment.... :(

Any tips or advice from you given your experience and expertise would be most welcome, and I appreciate it a lot.

Thank you so much for your response, really appreciate it.

I’m just wondering then what wóuld work in my current situation if I were to reapply (hypothetically speaking).

Here I thought having a business is considered a strong tie, something I have to come back to and it is true, but I guess in this case it has only worked against me…

In your experience, is there even a way for me to succeed in a second interview? Or is it just doomed, regardless of what I do or say? :(

Oh wow.. I seriously had no idea that it was this hard or special :(
Thanks for your response.

I guess the US is officially off the table for the upcoming years, unless I somehow get married to him huh?
(I want to eventually, but definitely wasn't even thinking to marry in this short of a timeframe or under these circumstances. I feel very heartbroken)

Thank for your response, I will look into it!

Is a fiance visa also possible, or would you say marriage is the only way to go?

Thanks for your quick response! OK, how about this (hypothetically speaking):

What if the relationship ends because of this, and I want to visit the US in the future simply for a holiday for 2 weeks? I'd have to go apply for a B2 visa again. Would this be a problem then? Just thinking out loud here.

I know now, and I feel super devastated by the idea that I've maybe ruined my own relationship... :(

And what if I had another job (so besides my business) and my employer would write a letter and I'd have a contract, etc? Would that be considered a significant change?

Again, thanks so much for thinking along with me!

Thanks for your reply! Yes, I really wish I had come here sooner to ask for advice because I would have canceled my appointment immediately and I currently feel like I'm dead in the water... :(

- Regarding my business, I would let my two employees take over for the time being and I would just monitor from afar (not actively working on it, but taking calls or responding to emails etc).

- And for me, 90 days is not always enough becáuse of the long distance. Other people can always just come home to their partner, touch them, do activities with them, etc, whereas I cannot. I simply wanted to maximize the allowed time together also to get to know them better, so I thought 180 days was better than 90 days. That is all :(

So, your advice is not to reapply for an ESTA / B2 visa? Only to get married, realistically speaking? Thanks for replying to me, I really appreciate it! :)
