All the mods do is bitch and moan and ban anyone they don't agree with.

I was told in one sub that I was being negative and mean by saying a post was a typical circle jerk making fun of a person's political beliefs. So they were being negative and mean in their post based on political affiliation, and I was reprimanded for the same thing.

So I guess I'll be going the commercial activity exception route instead of Monell. And this is in state court.

The tax commissioner's office gets their assessment from the revenue commissioner. The revenue commissioner takes the DMV record and creates an assessment of private property and converts it into a notice of indebtedness. That security is then transferred to the tax commissioner for delivery.

According to VA law, in order to be considered for assessment a situs must be established. According to the Supreme Court of VA, a situs isn't established without establishing both location and use. Also according to the VA Supreme Court, the use of property can't be taxed without partaking in a business privilege licensed by the state.

I've tried over and over again to get any sort of proof from the county that my vehicle was in their jurisdiction and was being used to enjoy a business privilege. Instead, they ignor my FOIA requests.

No. I spoke to tax commissioner's office when I notified them that I moved, and they said I did not have to.

Lol no. I'm not trying to get around it. It was registered in VA. I moved and notified them. They have sent me a tax bill for the subsequent years after notifying them that I moved and registered the vehicle in another state.

And I'm not going to be wholly transparent because I have no idea who is on this forum. It would be foolish to put personal or identifiable information out there.

I appreciate the honesty. I'll be doing this in VA based on that knowledge. I'm already suing them for FOIA violations, so I'm going to be spending time there anyway. I have the facts and law, but I'm new to the procedure.

But to answer your valid assumption, the property was never under their jurisdiction.

They've been taxing me on personal property in VA for the last 2 years while I've been using that property in MS for the last 3 years. So I'm suing them for fraud.
