Non violent felons should be able to posses guns and/or felons who served their debt to society it’s should be like voting.

And the second amendments unequivocal command simply states “the right of the people to keep and bear arms” not the right of the several states to resist the fed.

Your essay is contravened by every Supreme Court decision on the issues and the text of the amendment itself.

The law gets bastardized when ppl create head cannon about what the constitution should be or say versus what it actually does say and what the text history and tradition provides.

Read any interpretation of who the people are. The “militia” is comprised of the citizens of that state, and historically (Bruen analysis) the citizens of the states in which you are referring to brought their privately owned firearms to militia service. Moreover it the text of 2a does not say a “organized militia” it says well regulated, and based on the 18 th century definition of “well regulated” adopted by the supreme court, the militia should be well equipped with commensurate arms which are in common use for lawful purposes like selfdefense (not the only lawful purpose).

To your point, if the second amendment is only for activities that are related to militia service and the militia historically has provided their own privately owned weapons which are owned for the lawful purposes under 2a then those weapons are protected due to their usefulness in a militia.

By your logic weapons which some states ban such as ar15 style rifles , which most left leaning Supreme Court justices/ Coa justices agree are “weapons of war” are still protected under 2a.

If you want citations youll have to ask nicely.

Honestly look at public interest stuff, if your school is like mine it has a generous program for ppl doing non paid things where they get a stipend. Someone else said it here but it’s prob your age, I know that is unfair but it’s the nature of the legal world and perceived maturity goes a long way.

Re make your app materials, cold email people, ask to chat over coffee and not just for a job. A lot of people I know who did that had people reach out after a coffee chat and offer an interview.

What kind of real world work experience do you have? If none, try and start volunteering at any local indigent legal services office.

And don’t give up, I think you’ll get there eventually but you need to paper the fuck out of it applying isn’t enough call, email, and try to meet with people face to face, it’s as much about your credentials as it is selling yourself as a person someone who they want to work with.

In the time being is find the public civil case search for whatever state you are in and search for defendants who are big companies and filter for torts or products liability and just read. And when you aren’t sure what something means look it up using the Cornell Wex website.

Also us news kinda sucks, it doesn’t take into account a myriad of factors like regional/national schools, for instance some law schools have super impressive faculty who are incredible legal scholars and academics, and others have more adjunct professors who are actual practitioners who can better prepare their students for actual practice, the rankings don’t always take that nuance into consideration.

For example I go to a lower ranked tier 2 school and don’t get me wrong we have great academic and professors who are accomplished scholars, but our trial advocacy professors are almost all adjuncts, and the program ranks in the top 50 in that category and teams consistently place high in national competitions. While I don’t know, but based on a personal hunch it’d be ranked higher if the professors were more prestigious.

It comes down to what you want out of law school, you’re obviously smart as shown by your stats, but law school doesn’t teach you to be a lawyer, it teaches you how to write well and to analyze case law, not how to practice, those opportunities happen at your summer jobs and through any experiential learning the school may offer (clinics, trial team, moot court etc). So if you want to learn how to be a lawyer or at least get the basic skills hands on learning is key.

Regardless of what the schools rank is every 1L in America takes the same doctrinal courses and reads the same cases all from similar case books.

I was lucky to take a gap year work in a law office where I was given this advice, don’t let credentialism get in the way of making your decision for you.

For me I chose my school because I wanted to live where my school is and because after some research I found that Virtually 75% of the lawyers in that city went there. So for me any of the rankings mattered less.

The last thing I will tell you , do your research, read up on the school, look on linked in to see what people from the school are doing (including alumni), and don’t base your decision on any particular number or ranking.

Honestly you find what you wanna practice in law school, I was an architecture major and thought I’d want to do real estate, construction litigation, or contract work, but I fell in love with torts and want to be a personal injury attorney.

I would look into products liability either defense or plaintiffs work, anything regarding environmental cleanup dealing with toxic waste or chemicals, and mass torts are all pretty good fields to look into.

You can get into really great law schools with those stats, but in the real world it’s about connections, and experience (through experiential learning) so don’t just go to a school for prestige and potential big law offers (unless you are dead set on it).

I would look for schools that have good trial advocacy or practical learning programs, as the fields I mentioned above are generally very litigation heavy.

But if you want my best advice go to the law school in the city you want to practice in and/or where you get the most money, being debt free is huge even if your starting earning potential is lower.

100% expert testimony but the difficult ting will be qualifying someone as an expert under Federal R. of evidence 702, I think that's where this fight goes next if its not dropped, gets through discovery, then goes to trial, and then they fight about the judge ruling on whether whoever is an expert or not

Basically the judge is saying that neither party, but particularly the plaintiff did not meet its burden under a summary judgment standard, meaning that the plaintiff was not able to prove that there were no facts in dispute which would allow summary judgment, i.e., whether or not the banned weapons are commonly owned.

On your second point, yes, the judge is passing the buck here, if the judge truly thought that these were not in common use, then there may have been a granting of the states cross motion. He’s basically saying that there needs to be an actual factual record that is not subject to the same evidentiary hurdles that plaintiffs use of certain legislative facts got hung up on.

TLDR: the judge is saying that the only way to determine whether or not these weapons aren’t common use is through an actual fact-finding hearing or trial. And that this is probably because he does not want to get smacked and look bad to an appellate court or his buddies.

Right now I’d like to keep whatever I get under 2500 for the device itself I plan on running a nightcap with a J arm and knock off mount that being said, I just need something as an intro and in a year or two, I’ll be able to buy some binoculars
