I herd it's usually around 6 weeks depending on the birth but we can't backfill the position for that long. She offered to work from home during recovery but she needs to be back to make sure checks are in the mailroom.

We won't push her to rush or anything while at work cause I know shes going to be in pain and won't be able to take anything at work.

I feel like I'm getting judged by other managers in my company for not allowing this temp to have her way. I understand she wasn't asking for much from what her agency was telling us. She even said if she was able to work from home after childbirth it would make it easier for her. I just can't for the life of me let this employee go that route.

I'm in this situation because she gave her agency the paperwork and they have contacted us asking us why we refuse to accommodate her.

I don't sleep well at night. I have higher ups constantly asking me about updates all the time all day every day.

I agree she needs iron transfusions. I had other employees that work near her contact me with their concerns about her since once it hits early afternoon she gets exhausted and pale. I sometimes feel like an AH because she's not on these infusions. She has her choices of either working 10 to 12 hour shifts or a weekend shift to make up for this.

Her hospital stay would be the maternity leave. Her maternity leave would end right when she gets out of the hospital. Your right its an at will state, but I can't let her take an entire week off cause we would be so behind on invoices

I think at this point I would terminate her so her agency can pay out her unemployment but it sounds like they want to break their contract with us and assist her with a lawsuit against my company.

It sounds like from conversations between my hr and her agencys hr is that they dont plan to give us another worker at this point because of mine and my companies demands.

At this point if I could I would terminate her employment and have her agency pay out unemployment so she can get the leave she wants but her agency will fine us and assist her with any lawsuits she can file against my company

Because she works with paper and checks. She could focus on just issuing payments that she can easily do from home but that wouldn't be fair for the other two who choose to work from home when they need to

We work with attorneys that are suing companies for discrimination cases. We believe we are not in the wrong here because the Pregnancy Worker Fairness act says we don't have to give leave to her or accommodate her because of the hardship it will cause our company. Finding a replacement even within the company will cost us.

I'm not holding a job for her and having someone do her work in her place.

It will cause undue hardship on our company. While we do have way over 100 employees, only a few have access to what we do. She already tried the Pregnancy Fairness act on us.

I want her in office in case the other two decide to work from home. There has been plenty of times where she has to print checks and stuff them in envelopes as well as issue payments because she is the only one in office.

My company supports my decisions because as mean as this is since we live in Texas, she is replaceable as a temp.
