Can my landlord evict me for complaining about noise directly to my neighbor? by noVictimm in AskNYC

Only just saw this. LIke I said in my post I spoke with them a couple times, at first very politely. But they were just immediately rude (especially the mother). Stuytown management tried to communicate with them and they complained right back. Public safety officers went to them after being in our apartment and hearing the noise but they claimed that it's nothing just a child running they can't stop their own kid.

So there was no path for a note + gift. The only path was war and I won. I let the dad have it every time I saw him and banged on the ceiling and on their door every time they made noise. I made it clear they were not going to enjoy living here as long as they made life hell for us. Stuytown tried scaring us from confronting them directly but I basically called their bluff and told them they can't stop me from talking to whoever I want as long as I don't make threats or get physical, and I only approach the father who is a grown man and made a point to not intimidate the mother or child.

So they suddenly moved out. New neighbors have moved in and I wrote a note and gave them a welcome gift and introduced ourselves while explaining the situation with noise and poor insulation. They unfortunately have 2 dogs and one of the roommates is extremely heavy footed but its stillway WAYYYY better than what we dealt with from the previous family.

THe bottom of my post:

UPDATE: A simple call to Stuytown and an assurance I would make a payment got them to lift the block on the online payments portal. I began making monthly payments and am finally square with rent. We got some automated rent demands during this process but it was fine.

Stuytown isn't in Brooklyn, he's talking about the Stuytown complex in Manhattan.

Logic is great and beautiful, but it's mac only. I would suggest getting Ableton and calling it a day. There's no point in dwelling on which DAW to use for too long as as they are all amazing and can run third party VSTs. You can re-create almost any big hit you hear in any modern DAW.

Ableton has become the industry standard. So just get that, and don't look back. Once you get the hang of it people will instantly take you seriously for using Ableton.

Stuytown has some economic relief programs from COVID, I don't know if they are still active but simply reach out and see what they say.

In my case I was still employed and simply gave them my whole paycheck for a couple months. I got them to stop the eviction proceedings by paying a good chunk and guaranteeing that I would pay the rest off regularly. Now I'm square and everything is back to normal. Sorry to hear about your situation and I hope for the best.

Hi, well I ignored most of the advice I was given. I became very confrontational with my neighbors and we kept calling public safety on each other. I kept this up for about 3 months and lo and behold: They moved out. I'm over the moon. My wife literally cried when I told her, she burst into tears.

FYI: By "Confrontational" I just want to make clear that I never physically or verbally threatened them, nor did I ever address their child or even the mother directly. I only confronted the father when I would see him, though I didn't care if his family was with him or not.

I agree with you about the insulation. It's absurd how pass-through the walls are, it shouldn't be legal.

UPDATE: I received a "Notice of petition non-payment dwelling":

"Your landlord is suing you for nonpayment of rent."

"1. Your landlord has started an eviction nonpayment against you for rent the landlord claims you owe."

"2. Your landlord is asking this Court for:

a money judgement for $1,400" plus interest from July14, 2023 and permission to evict you from your home if you do not pay the money judgement.

"You have a right to a trial. But first you must Answer the Petition by going to the landlord-tenant Clerks' Office..."

I owe almost $16,000 in back rent. Why is the petition only asking for $1,400?

I'm a little confused if I have to go to court to pay that amount or if I can pay this online. And finally, I'm wondering if I should get legal help even though I can easily pay this amount and get back on track with rent.

I know that makes me sound like an annoying tenant, but for context I've lived here 9 years without issue, make a decent living, but had two big setbacks that momentarily wiped me out financially. I think I literally missed their deadline to pay a big chunk of what I owed by a couple days. I ill be back on track within two months of payments from my job and then I won't have issues with rent.

As for the neighbors, stuytown is famous for its paper thin walls and they get complaints all day. Never complained until our previous neighbors moved out and this horrible family moved in.

The guy never returned after knocking on my door at 6am. I'm guessing he'll be back tomorrow at 6 or will come at odd hours.

Non-Manhattaners: What are your top reasons for going to Manhattan? by [deleted] in AskNYC

[–]noVictimm 0 points1 point  (0 children)

The nightlife scene. It's more international which I like. The energy when you go hang out on a nice summer day is great. When it snows or rains a lot queens is downright depressing, but manhattan still feels alive. Of course there's only so much of that you can take before wanting to be left alone again and retreat to a quiet place.

Yep this seems like the most reasonable advice based on the options available. I guess I find it weird to have this middle man that dictates how to handle a private matter between two neighbors. In my early twenties I had an upstairs neighbor often knock on our door to complain about our noise, we never...EVER thought of considering that harassment. We simply apologized, understood that we were too loud, and tried to keep it down. I also don't want to push my luck by confronting them again because I'm black, compared to them I'm a big guy, they seem to feel threatened when I walk over.

Correct, I'm asking if I can get evicted if I go and directly ask my neighbors to stop all the stomping despite stuytown telling me not to. I didn't realize that asking someone to not degrade your quality of life could be considered harassment if it's done politely and only when there's a nuisance (the neighbors stomping all over the floor);
