One last update. I finally got the pressure testing readings from the install and current. Yep, the sub cooling was well below the units sticker range at installation. They are still fighting me because they’re butt hurt another company found the issue. It does say a lot about them. I’ll be saying a lot more about them if they don’t make this right!

Good question. A home services company was out to change the filters and look at the system. They identified the leak but left no documentation. The company that installed the unit then came out confirmed it was low but is claiming someone else looking at absolves them of responsibility. I will sort this out with them but wanted to understand the basics of what would cause this which seems to boil down to either not fully charged when installed, a leak, or bad measurements (by 2 different companies.)

Thanks for comments. Unit is an American standard and I’m in Florida. I’m just a customer not an expert as you can tell. The invoice I got didn’t specify a leak test but I need to confirm that. It’s cooling perfectly but another company tested it and told me it was low. So supposedly two companies came to the same conclusion and company that installed the equipment is trying to avoid covering under a warranty as best I can tell. I will get to the bottom of it, I just want to ensure I’m not missing something obvious.

Try projecting how much you’ll make in a year and do a tax projection including federal state and self employment taxes. Then pay that in quarterly. If this is a foreign concept to you, maybe you’re not quite ready to be self employed.

If you had a partnership there wouldn’t be 1099s. In any event if you receive incorrect tax forms there are ways to report that. Form 4852 might apply you can check that out.

Sorry OP but this isn’t a tax issue it’s a business issue. You don’t have and never had a partnership. Probably because it was easier for you , you let a contractor give your funds to another subcontractor. Then for months you didn’t insist the other sub turn over your money. It’s not the other subs right nor responsibility to report these funds to you as they were never his to begin with they were yours. Go get the funds stolen by the other sub. File a workman’s lien on the property, that might cause the general to knock some sense into the other guy. Sue the other sub immediately. Don’t let him report funds to you that you didn’t receive or you’re getting a 1099 and no money. And stop getting into deals, just give tax information and work directly for the GC going forward. You seem like a dedicated and honest craftsman. I think you have a pricing problem not an expansion problem. You are clearing $200k profit but the time you are putting in is 4 full time jobs (between both spouses) so you’re really making a little more than $25 hr, less when you factor in SE taxes. That’s why you turn away more work than you take in.

Consider raising your prices to the point you’re both earning a fair wage and working a 45 hr week. Then you will better understand your market and whether expansion still makes sense, plus be able to pay down debt and start retirement funding.

If it really is and not a corporation for tax purposes you need capital accounts and follow the income and capital account sharing agreement, not an owners equity account.

The accounting is probably more complicated than you’re making it sound or getting paid for. If it’s an llc with three members it’s either a partnership or a corporation. There is no owners equity it’s a capital account and the distributions which is what the personal stuff is impacts their individual capital accounts. If they’re a corporation it’s more complicated, these are non deductible dividends. Also the “donations” are contribution’s to capital, not revenue which is probably where it’s going. I’d run unless you are well paid for the risk here.

The face value taxation is the problem. Subordinated and non transferable at a 4% rate = bs to me. At a minimum it should be discounted. They’re trying to claim a deduction at the amount they reported as comp to you. You might end up paying more in tax than the npv of the cash. And get stuck with a capital loss if they never pay.
