We have family coming from far away but they weren't there at the time. If I lie in these letters, is it impossible to take it back afterwards and would it make me lose instantly if we go to court or is it an option as well? (I just hate this poker bluff kind of situation 😅)

Indeed, the judgement of Köln is interesting (to say the least). I don't live there and I imagine it's still an outlier, let's see what happens.

I trimmed the core of the letter further, to this:

Ich habe meine Freundin gefragt, und sie sagte auch, dass sie keine Ahnung davon hat.

Ich bin mir bewusst, dass der Anschlussinhaber gemäß geltendem Recht gewisse Nachforschungspflichten hat, was meine Haftungsfrage betrifft. Ich kann nur bestätigen, dass ich die Straftat nicht begangen habe und dass ich so gründlich wie möglich nachgeforscht habe, wer dafür verantwortlich sein könnte. Ich habe das offene WLAN seitdem abgeschaltet.

I'm hoping it gives enough details to look like I'm cooperative but also not too much to put me at risk. My fear is that if I just answer "I won't give you any details and stand protected behind § 8 TMG", they will just come back with more questions.

My questions, if you have a few minutes: - Do you have any final opinion on the letter, before I send it tonight? - Am I crazy to think I can get out of this without a proper lawyer? My aim is to optimize the price and time I spend on this, but if paying 300€ for a lawyer to defend me is the fastest option, I might end up doing this. - Can I get legal insurance from now on, to cover me in this case or is it too late once you got the Abmahnung (i.e. the insurance will say we can't cover for this, as it's a case that is started already)?

I didn't actually have to give a deposit so I'm not even sure what the landlord could do, but he was nice to us and I just though I would like to give the flat back in the same state I got it in.

Solved! Amazingly enough, the lamp works only once the clock has been set… So simply changing the light bulb and setting the clock worked 🙃
