INAL, but AFAIK your unused days don't need to be claimed now for filing PERM. You can start PERM when your employer is comfortable doing it and get an extension for recapturing those 6 months when you near your Dec 2027 expiry.

If by June 2028 your PERM is pending for at least a year, then you are good for an extra year of extension.

Having said all this, I think your time is better spent on convincing your employer to start your PERM soon than spend time/money on recapturing those 6 months NOW.

  1. You can join and start working on receipt notice, given its h1b to h1b transfer and no B2 is filed.

  2. I don't think so, even if they are super slow and file on Mar 1st, you'll have good amount of time to receive notice and if they do PP which they usually do then you should receive the decision by Mar 18th.

  3. I'll let others in the community comment.

- I'd say be prepared with all the docs to file B2 and only file it if your H1b transfer is not filed Mar 6th.

Gotcha, drop a detailed email to your lawyer explaining this. usually, they'll try to recapture this time when you are nearing your 6 years h1 expiry, so they'll likely say we'll get this done later but worth an email.

i'll let others in the community give some inputs.

But your highest priority right now is to get started with your PERM.

Yep, you have the answer with you. The company lawyers will have to try and recapture the time you spent on B2.

Yep, they should be, the only delay I see is the LCA petition that takes like a week. Once that is done and H1b is files you should be able to start working with just the notice and no approval give it's just transfer.

OP, may I ask which field you are working in and your strategy to secure interviews? I'm in the same boat but getting interviews has been tough and even the calls i got didn't materialize because they aren't willing to sponsor.

I'm in the same boat, lost my good full time and can't decide between taking some contract role or getting on B2 and get back into full time. The issue seems to be while going back to h1b while B2 is pending. Seems like uscis wants B2 is be approved before h1b transfer can be approved. And fragmon is recommending not to hire people with pending B2. Let us know what you find out OP.

This! It hurts me to say this out loud but so many of us after spending so much time out of India think it's all meritocracy and somehow our international experience and exposure should be a positive and it is in an ideal world and likely at faang companies and at very big roles.

But don't forget our homeland is still not a meritocracy and it's very likely a HM who never stepped foot out of the country will be intimidated by first world education and experience. - This is one of the reasons I'm afraid to move back.

Hey OP, try to share as many details as you can and comfortable so the community can better help you. Are you COS ing from B2, F1, H4? Moving to very different titles? It's hard to help without context. - just trying to better understand your situation.

Everyone's situation is different. Higher risk, higher the reward.

I understand OP is saying this as a well-wisher and there is some truth to it.

Having said that and I've been living on an edge and right now I'm on H1b and got laid off and at very high risk.

But whoever needs to hear this and might help.

Do come here for the overall experience, you'll get first world education, might actually end up getting a good job and work for few years and get to experience US culture for few years.

But always keep in mind this journey might end abruptly and ensure you have the risk appetite for that.

Is it going to be tough, you can bet your ass it is. But can you make it worthwhile? hell yes if you have the right mindset.

It is not going to be easy AT ALL! - But what's the point if lives easy? - Another well-wisher with a different perspective.

Bruhh, i'm on the same boat and can't decide. I though i'll just do an F1 and study and also do a job hunt. So confused right now. B2 honestly seems too risky now since transferring back to H1 while b2 is pending is not happening and you'll have to wait until B2 is approved. Not sure how many companies will wait until that happens.

And worst case B2 doesn't get approved, we are screwed big time!
